    I was under the impression that companies do charge to manage an IVA. :confused: Whether this company is out to make money from you or that is the best solution I don't know. I would tell them that you are unsure and need more time to think about things as it is a big step for you. I believe an IVA would affect your credit rating which can have a bearing on you holding certain jobs but I am not sure about the Scottish equivalent. I would hang fire until you have spoken to CAB or CCCS or Payplan.

    I would def go with cccs I am with them and life is so much more simple, really the sleepless nights have gone too!
    I am not a fan of IVA or things like that as if circumstances change then you are locked in for 5 yrs and cant reduce your payments. My life has changed in the last few months so goodness knows where a I will be in 5 years. Hold fire with deciding anything until you have spoken to one of the FREE debts charities, there is help out there, but there are also sharks who prey on the weak.
    Debt free and plan on staying that way!!!!

    I would also ask if you are being chased for any of the debts?
    Has anyone sent letters demanding payments?

    Also, when was the last payment made to these debts? Has there been a 5/6 year period where no payment has been made and you have not acknowledged the debt IN WRITING? If so then the debt will be statute barred. (5 years in Scotland, 6 in England - but it may depend on what the T&C said as to which system your agreement falls under).

    If someone asks you to make a payment towards the debt, i would advise asking for a copy of the CCA (Consumer Credit Agreement). I would also write to Allied International and request this - you are legally entitled to this information and if a company is unable to provide it within 12+2 working days they cannot legally pursue you for payment. After a further 30 days the debt is unenforcable and the DCA has committed a criminal offence.

    I am realy confused now.

    Just been on the phone to the CCCS who have me booked in for an appointment on the 21st of April.

    They are telling me to withdraw all my money out of the Think Bank account i have as it is part of the RBS who can take money out of it and set up a basic bank account and stop all my direct debits.

    I will do that with the metropolitan collections thanks for that.

    The major problem i have is my equifax credit report is showing the debts belong to the source and not the debt collection agencys.

    As things stand my debt with clydesdale is owned by Cabot Financial, so i phoned them who tell me they have no record of me, but Capquest if chasing me for the same debt, i am am reluctant to offer payments to them as they apprently dont own the debt.

    Its the same kind of thing with RBS they tell me Capquest own the debt, but Capquest apparently put the debt back to RBS 6 months ago.

    Im not being chased from any1 apart from capquest for a debt they apparently dont own!

    This has been 1 year and 4 months.

    Im off out away to withdraw all my money and put it into my savings account with the nationwide and ask them if i can set up a basic bank account with them.

    You've told the deed people to get stuffed, you've talked to people who'll help you and you're protecting your interests....all done quickly...brilliant.

    Just keep it up and ask the questions that come to mind and the knowledge bank on this site will help you in the right direction...
