Primark - May not be a rant

My girlfriend tends to buy from this shop a lot. Personally going into it is my idea of hell on earth... Anyway, their returns policy is that they will only return something if you have a receipt, even if they still have the tags on etc. I'm guessing if she's lost the receipt then she's screwed? I'm not sure if this is vent really as they may well be in their rights but not many other shops operate this system.

    They are legally obliged to ask for a receipt unless the goods are faulty.
    I also think it depends which store you go into for a exchange without a receipt.
    I have never had any trouble in Kilburn or Hammersmith (but I only had one item) but in Wembley they're not budging.
    Quite a few shops refuse to exchange without a receipt and as mentioned before that's their perogative.
    One of the reasons why I refuse to buy anything from Karen Millen shops is because they won't even give you a refund with your reciept unless it's faulty, so I buy from their concessions which have to follow their host's refund policy.

    Cheers for that. I thought it would be the case. She buys so much stuff from there its untrue. She's got a wardrobe full of stuff che can't return because she decides to bin the receipt, but she'll keep the one from tesco when all she bought was some milk and bread.

    I don't think there is a legal obligation on them. It is up to an individual company to decide what their returns policy is, i.e. many shops will (as a goodwill gesture) refund in credit notes when no receipt is produced.

    Some will only accept returns on faulty goods (an no others), but in that case proof of purchase doesn't "have" to be a receipt (which I think is the second part of the above sentence)

    Although this is a bit off-topic I think people get confused about legal rights and refunds because some shops (M&S, Next etc) give refunds (with receipts) if the buyer 'just changes their mind'.

    As me4bargains says, a number of shops will only give credit notes unless the item is faulty.

    I think one reason why shops don't give refunds without receipts is in case you've bought it in the sale or from a charity shop.

    maybe it's worth your girlfriend trying for a refund (although most stuff in Primark is so cheap it may not even be worth the time and effort).

    It probably comes to around £40 altogether, so its not the end of the world. Its probably my fault anyway as I insist that she just buys it rather than trying it on as every second I'm in there a part of my soul is destroyed.

    IIRC no shop has to exchange items if the customer changes their mind. If they do that it is a 'goodwill' gesture.

    The only time a shop must replace or refund the item is if it is faulty or 'not fit for the purpose'. In that situation you just have to prove that the item was bought from them and not elsewhere. This is why the receipt is used.

    I agree - try ebay, if its high fashion theres plenty of people on there who buy items for more than the ticket price.
