Advice on mis-selling by estate agents

I hope someone can help me here.

The house which backs on to my mum was sold last month after being on the market for at least 6 months.

It was bought, refurbished and sold by someone wanting to make a profit with them never having lived in the house.

Basically the house has 2 very large trees at the bottom of the garden which need cut down but the seller put a 6 foot fence infront of the trees to make it look like they were part of my mums garden.

My brother contacted the estate agent to advise them of this. The agent said that she would contact the sellers solicitors as they were breaking rules etc.

Anyway said house has now sold, estate agent will not return calls and the fence is still in place.

Is their anything we can do? The new buyer will not bother about them and I don't want my mother to end up having to pay for tree surgeons etc as it is nothing to do with her.

    Does your mum also have a six foot fence on her side of the trees?

    I would have thought that the boundary markings on both your mums and the other house deeds would have shown who owned the trees, but I think your mum would probably need a solicitor to clarify that.

    Who has determined that the trees need cutting down?

    Nope - no 6 foot fence on my mums side.

    There is only a 3foot small metal fence (the type they had in the 50s and 60s).

    It is clear to see that the bottom of the garden is about 4foot shorter than the neighbours on each side.

    The trees are growing at an angle and look as though they would probably fall down if we were to have the winds that we have had already this yet. The only problem being, if they do blow down they will fall into my mums garden.

    Estate agent said she will contact the sellers solicitors and sort it out but every time my sister calls she 'isn't available' or 'will call you back'.

    I don't want it to end up going down the road of us having to get a solicitor. My mum is elderly and can't afford it.
