Just take the damn car already

(Note: Apologises in advance if this is in the wrong place!! Spent a long time umming and erring over it!!)
I am getting sick and tired of recieving notice that my car is going to be repossessed!! Just come and get it already!!
I stopped the payment in November as I could no longer afford it, and the payments have gone to keeping more essential things in life. I was happy to admit that the car - A mistake in the first place under pressure from OH to buy that particular car - was going to be repossessed and quite frankly I will be glad to see the back of it.
15th Jan I recieved my first notice from the Collections Agency. Rang them up and informed them there and then I had no intention of paying and that they can come and repossess the car. Yes Madam, they will arrange for someone to collect the vehicle within the next 10 working days.
No collection.
11Feb I recieve another letter threatening repossession of the Vehicle. Rang again, had no record of me wanting the vehicle repossessed. Once again, told within 10 working day. No collection.
Start of march I recieve a letter saying that the vehicle will be repossessed within the next 7 days. No collection.
End of march exact same letter, no collection again.
Yesterday I recieved another letter saying the same.
I am sick of waiting for them to come and collect this damn car!! It wouldn't be so bad if everything they sent me a letter, they didn't add -more- charges which will be taken off the auction price and leave me with more to pay on the outstanding balance!!
GRRRR!!!

I would suspect - given the 2nd hand car market is rather "dead" they don't want to have to be involved in trying to sell another car for which they will get a low auction price - their approach by sending repeated letters is probably to "frighten" you into paying and wanting to retain the vehicle until the agreement reaches its natural end.
If you really want them to take the car (after you've considered and evaluated the considerable financial loss you're going to take in this process and after carefully reviewing the T&C's of the paperwork involved) - I'd suggest writing to them telling them to collect the car as discussed in a telephone call on 1/1/01? - send the letter recorded delivery. Personally I don't rely upon phone calls - they are easily denied.
This should then assist with your position as regards having further charges and penalties levied, but a word of warning - the collections/debt recovery company "may" still hold you liable for every cost involved until the vehicle is sold, including charges for storage etc - best to read all the T&C's carefully and if you really arn't sure seek further advice.
Hope that helps.0 -
you would have been better selling the car yourself0

Yes you can. It depends though, on whether one would be that unscrupulous and also whether the buyer would actually do a check to see if there is finance on it (assuming, of course, that you say no if the question is asked).0
