Hi ther. Following on from my previous post "Written off at 17! Ouch" I have found information which suggests that legally you can demand your car NOT to be written off.
If i took this route of action, what would happen?
Thanks

My father had his car broken into about two years ago and vandalised and as it was of such low value the insurers wrote it off. At the time we took advice about disputing the ruling and was told that the insurers would charge us for towing the car back and would refuse insurance on it. The DVLA would be advised that the car was written off which would mean huge problems even if we did get it roadworthy as records would show the car was a write off.
In the end we didn't persue the matter as my father had to keep the car on the road as he had no drive or garage and we were told on a legal forums that keeping the car physically on the road as a write off would be an offence.

Good luck for that, hopefully it won't be a write off and that will solve some of the immediate problems at least.

Honest John (the Telegraph's motoring correspondent) reckons that, if it's a third party claim, you can insist on the car being repaired not written off.
But as you were responsible for your accident, merciless, and as Soo's father was claiming for malicious damage rather than against a third party, you can't insist on it being repaired - your insure has the right to refuse to repair if it's economically not worthwhile.
I'm glad to hear that they are happy to repair it, merciless - way to go!0 -

Great news indeed.
The excess charge is enough to keep me down money wise, but at least I have a car at all now.[FONT=Arial, Helvetica, sans-serif]"The internet is a great way to get on the net."
