Unauthorised Debit from my account - Please Help!!!

:mad: I have just gone into my current account and found it nearly £300 light, I checked my online statement and found a debit for £289.87 of which I had no knowledge!!

I rang them to find out what it was and was told although they had not done it they could see it had been made via Barclaycard collections??

And as per standard they only open office hours Monday to Friday..

I did have a Barclaycard back in 2006 and did end up in arrears due to an injury at work, but once fit again paid up the amount owing. I have since 2006 had no communication or conversation with them and had no idea they still had my details active. So you can imagine my shock, anger and total frustration at the fact I am having to wait a full weekend to even discuss this matter.

The barclays current account rep made it quite clear that the only connection between the two groups was the name Barclays and he had no knowledge why or how this could happen!

Even if I did owe them an ammount, surely they need my approval before they go raking lumps of cash from a totally seperate account - Im fuming.

Please advise or answer these queries..

1. Is it legal for them to withdraw cash from my account without a direct debit or standing order in place?
2. If they refuse to replace cash into my account who do I contact to make a formal complaint and seek legal proceedings.

  • Yes I have paid all the money I owe but cannot find a receipt anywhere in my documents I keep..

    Even so - they still have no right to access a bank account without permission!!!!

    Oh yes they do.

    It's called the right to set off.

    If you owe them money and you have the funds in another account they can claim it and set it off against the debt.

    Always best to pay your debts.

    Or at least keep debts separate from assets.

    What you think you may have paid/owe is obviously different to the records they have, unless you can prove otherwise. Was this a deafult where additional charges were added to your debt and the amount debited are the extra costs ?

    And yes, they can take funds from another account if you are in arrears. If you still have the T&C's for the current account you might want to read them as it will confirm this.
