Non-adopted estate

Hi guys

i'm not sure if this is the right place to post this, please feel free to move it to the correct place if need be!

I live in an ex-MOD property sold by Anningtons about 6 years ago. at present we all have to pay a maintenance charge each month, although most of the properties are free hold houses, because the local council haven't adopted the estate

Does anyone know how to go about asking the council to adopt the estate

any advice greatly appreciated

    AFAIAA it involves the Highway Act 1980 (it's known as a S38 Agreement for new build but am not sure which section would cover this one), and your best bet is to talk direct to the local Council - different Councils have slightly different titles for the Dept that deals with this - it may be Highways or Environmental Services. There may be a link direct from your Council’s own website.

    You have to put in an official request, normally on a particular form, and the road has to meet certain standards in terms of lighting, surface water drainage, condition of the carriageway, footpaths etc before the Council will agree to it becoming maintainable at the public expense: this includes a provision that obviously the road become passable by the general public. Maybe it's worth you & your neighbours having an informal chat with your local Councillor first?

    It shouldn't do, I live on a newish estate which took four years to adopt & the council tax didn't alter as a result. Neither did the service from the council.
