Seller has given me the RAGE

We offered on a HA home, at the interview with the HA it was hinted that the seller was having to sell as it was that or repossession.

We were advised by the HA that we by being ready (had mortgage etc. ready to go, no chain) was the only reason bank agreed the house could be offered and not just repossessed. So we thought we were the answer to this woman's dreams as she got full price (HA no bargaining allowed)

Not likely, she has informed us (after we have paid £2000 in fees, handed notice in on rented and waited weeks) that she will not sell the house she will get repossessed as she believes this will make her involuntarily homeless and as such the council will have to provide her with accommodation as she has children?!?!?

She stated yesterday it was NEVER her intention to sell the house to us. She just did it to extend her time and keep the HA off her back.

I HAVE THE RAGE.

Please tell me that this woman has her facts wrong and all will be well in my world as I float serenely through the sh*t storm when she discovers that the council/HA wont do what she thinks and the deadline the bank gave us is too close for us to complete.

    This woman may think having kids will give her the right to council housing but she is wrong. If you do not pay your rent and are evicted you have made yourself homeless, the council have no duty to house you - with or without children (another long running thread on this board as a lady with illness did not pay her rent, was evicted and despite having 2 kids was refused social housing). As this lady has not paid her mortgage and has been repossessed then I would have thought the same applies.

    If it was this easy then everyone would just stop paying their mortgage to get a cheap council house, surely??

    You might want to tell this woman somehow if she thinks she is in for an easy ride that she might want to think again. 2 days ago the court gave us 14 days to leave the property and so in 12 days time we are supposed to leave. Our Longterm LL (over 10 years now) is selling the house and as rents are so high now and we don't earn enough we cannot rent anywhere else. The council have known about this for 5 months, they are the ones who told us to stay put after we was asked to leave, we also have 2 children, one of which has learning difficulties and behaviour problems. The doctors have all said he needs security and stability, we have doctors/proffesionals telling them this since November - and they still don't have anywhere for us to live. It looks like in a week and a half we are off to a homeless hostel. You might want to point her in the direction of this website if she thinks it is going to be easy to lose one house and get another!! We have paid our rent (and still are even though we have been ordered to leave) and are still struggling to get anything!! We don't even have a meeting with the homeless people until 6 days before we have to leave.

    Does not help you though, she seems to think that she is entitled and can be blase about it all so I don't think she is going to budge. I guess you can try to tell her but she clearly thinks she has it all sussed out. Yes, if she sells then she has made herself homeless but to get the house repossessed is just as bad and surely if they flog it at auction she will have a debt to pay as well. Mad, crazy woman, she has clearly not been advised correctly at all. She is making herself homeless still but then she might have a debt rather than selling and not owing any money.

    Edited to add as I thought of something else: If she has not paid the rent part of the house then she won't get anything. If you look on any HA/Council website, if you have not paid your rent to a Local Authority and have lost your house for this reason then they wont give you anything. Your solicitor should know this anyway and it might help to get a letter sent to her via them. That might be of more help.

    Edited to add something else: How long has she been in the house, do you know? Would she come out with money by selling at value? This way she would have money in her pocket rather than taking th chance of having to owe money if it does not sell for the amount she owes (I am right in thinking she would still be liable for the difference if it sells for less, is this right?). Silly mare, she has clearly not been on MSE to get the correct information.

    She sounds like a right pain in the behind.

    I would suggest getting in touch with her bank direct, you might be able to come to some arrangement once repossed as you are in a position ready to proceed. Even if they are obliged to go down the full route of offering to the market to acheive the best price, you are still in the best position and would hopefully be able to secure it, as an HA property it will restrict who is able to bid somewhat. The bank will be looking for a quick exchange, you will look ideal. You never know, you may even get it cheaper.

    Downside - it's going to take a little longer, hope you will be able to stay in your rented of extra time.

    And as for her, Karma will come to bite I'm sure, even if she does get a council house, I think she will find the world of emergency council housing a little less salubrious than she imagines...

    Oh, and someone will be along in a minute to tell you prices are about to crash.....:rolleyes:

    She actually sounds like an ex friend of mine. Was going to get her house repossessed so she sold up for a low price, rented private and then blew the remaining money in about 6 months, got herself pregnant, got HB, then LL sold up so she went to the Housing People and said 'give me a house' they said she would have to go into a hostel first, she was furious and refused, they told her to go on the list and wait and that it would take about 10 years to get somewhere. She had the deposit (from when she has originally rented private) with the LA who then used this to secure her another property and 5 years on is still renting privately.....

    Some people expect to be given everything for nothing, I accept we are waiting for a place as we have tried all other avenues and we can't get anywhere, but have accepted we will probably have to go into a hostel before we get anywhere, I don't like the way everything has to be done - courts, eviction order, etc... This woman will still be there until the bailiffs throw her out. Bearing in mind, if the HA file tomorrow the court date wil be 4 weeks time, the judge gives 2 weeks for her to leave (although she can ask for up to 56 days if it would cause hardship). Apparently (just finding out this) we could be here another 6 weeks before the bailiffs turn up and we don't have to leave before then.

    This means that if you want this house you could well be waiting another 3-5 MONTHS before she is actually out, so for now you'll have to wait longer than you antcipated (maybe). Sorry it is not good news but thought I would tell you what you can expect. maybe someone else can come along and offer some mre advice, mine is just what happens time wise I am afriad.
