credit card of a deceased family member

Hi

my father in law has recently died leaving an outstanding balance on a credit card. We were advised by Citizens Advice that all debts died with him however, the bank who provided the credit card are using some money that was left in a savings account in his name to pay off the balance.........

Whilst I accept that the money is owed to the bank, how can they do this if the debt is supposed to die with him...........is this correct?

Can anyone help please

    I was always under the impression that debts had to be paid from the deceased's estate first. If there were no funds, then the debt dies with him/her.

    aliasojo is correct.

    Also, many CC's have clauses in that allow the bank to take oustanding monies from other accounts held by the account holder.
    Gone ... or have I?
