Advice Needed Plz Being Evicted From Homeless Hostel

Options
i am posting this on behalf of a friend who is currently live in a homeless hostel ( same as me). so some details might be a bit sketchy

today she was given a letter for noice to quit the hostel within 7 days.

she has been in he homeless hosel for 1 year, and has taking the local council to court of legal eviction at her previous address, she has won at a tribunal and is waiting for it to go to court i believe.

she has 3 children living with her, aged 11 , 5, and 22 months her eldest is 21 yrs currently living with her nan because there isnt room for her here and she would have to pay £47 a week in rent even though she wouldnt even have a room of her own. her son is 18 and has joined the army but comes home at weekends.

5 yr old also has aspergers / autism.
because she is taking the council to court, .... she has been told that they would offer her a property and £250 if she takes the house and that will be the end of the matter ... bu she has to ake their offer no matter where the house is or what state it is in. or is she persues the matter then he 7 day notice stands. and she would have no where o go with her kids.

any one with any advice would be greatly received.

Her situation is so complicated, I don't think anyone here could give you a good answer. Can she go and see citizens advice, or maybe shelter, and try and get some professional advice?

What a nightmare situation for her. :-(

Take the house. If its not up to much then her 2 adult children could help her get it up to scratch.

Your friend really needs to go to a specialist housing advice service or speak to a solicitor specialising in housing law.

This area is very complex and with only basic details is nigh on impossible to advise on correctly.

I assume that the hostel was provided by the council homeless persons unit and therefore they are giving her notice as they currently have no legal duty? If this is the case, then they do not have to continue to accommodate her whilst she is awaiting an appeal decision on a homeless application. It would be discretionary if they allowed her to stay.

However, you say that she is taking the council to court for illegal eviction so would this hostel have therefore been provided by the Housing Department rather than the Homeless Persons Unit?

As I said, this is a very complex area of housing legislation and therefore I strongly suggest she seek legal advice immediately if she is going to successfully challenge the notice.

Take the house! She has 3 young children to care for, and beggars can't be choosers in these situations! As someone suggested, I'm sure her older children will help make it homely.

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Shelter may be able to give more help. http://england.shelter.org.uk/home/index.cfm

She needs to get her own advice from professionals in this case. I wish her luck and hope she gets some helpful advice. Does the hostel not have any workers that could guide her towards some helpful organisation?

My daughter and her husband have just been given a council property in an area with a bad reputation but the house is fantastic and so far they have seen not one bit of trouble. They have done their best with the money they have to make it lovely and homely and it is fine. It isn't all doom and gloom. They are just really, really thankful that they have been so lucky and been given a place.

the homeless lodge was provided by the council's homeless section, was classed as being intentionly homeless but there was an appeal and tribunal and it ruled in her favor, there was never a debt in the 1st place in which they admitted but by that time she had alredy lost her home and most of her belonging. is alredy seekin advice from a solictor but hes been changed 3 times and not by her choice. she has been battling this since 2005 yet didnt evict her until 2007, all appeals and paperwork were ignored or lost by housing benefit section at that time, basically she and her kids lost home and personal items due to someone's inability.
