eBay Dispute open as a buyer, seeking full refund + postage

hi all
looking for advice, I have opened a dispute up with seller as goods not described as listing: and have asked for a full refund. However the seller has replied to my first post 7 days ago questioning why I made no contact they have went quiet after a couple of personal emails. I now am only going to communicate through the dispute portal.

I am thinking of submitting the dispute on the 8th day of opening. Do you know if postage is included in any refund. I paid paypal, but 45 days has passed so missed that window. I just managed to raise the dispute within the 60 day eBay timeframe. I think I am no 61+ days after buying.

I get the impression the seller is avoiding me knowing he has sold poor quality product, however he continues to trade. I paid very high postage fees (i guess to reduce his fees on very low final selling price)

This dispute has lost it's communication so seeking full refund as no compromise could be reached. Do I get all cash incl postage refund from eBay in this case?

    it's difficult to say without a bit more info.

    How come you only started the dispute after 2 months?
    What is wrong with the item?
    Can you prove there is a defect?

    Theoretically you get a refund of postage and purchase price, but NOT the postage costs you will incur to return the item, which you will have to do recorded or special.
    It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

    Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.

    Without going into too much detail as the case is live, details are item sold with long term benefits and after 7weeks, due to the illegal activities surrounding the mobile phone, it has stopped operating and now i am unable to use it.

    I hope to get cost + postage refund, but wss entering into discussions with the seller for a compromise, but it has went quiet, and i think he may know something i do not? have you any experience of this?

    I'm assuming you've opened a dispute in ebay, if so an ebay dispute does not get you any money back, it is only a dispute as the the trustworthyness of the seller and if they find against the seller they will put a mark on his/her account.

    Only a paypal claim gets any money back, and as you say they have a strict time frame for that which they will not extend.

    It is always worth noting that sellers are not allowed to sell goods that cannot be delivered within 30 days, so your disptue against the seller if coupled with a complaint about listing breaches may well get them a suspension, but won't help you get any money back.

    If I have misunderstood and your claim is through a credit card then assuming they find in your favour and accept a chargeback you should get the full original payment refunded.
