NCD ripoff Dial Direct

hi i am looking for some advice,
my husband had his car insured with dial direct with 9 years protected NCD.
however he had 1 claim in april last year and the car was written off. he then followed the correct procedure and returned the car to the road, all the time his car insurance was valid.
when dial direct sent his renewal quote in february 2008 it was for only 3 years no claims.
numerous calls later and it has transpired that dial direct changed his policy in may last year (without notifying him in any way), and did not put NCD protection on the policy.
he has spent ages on the phone to them and doesnt seem to be getting anywhere. he has told them that he is going to see a solicitor but it does not seem to make any difference.
his new insurer is constantly asking for proof of NCD and he has explained the situation to them but they are not going to wait forever.
i feel that they are in breach of the terms and conditions of the policy and acted illegally by not notifying him with notice about the change.
dial direct state that they sent out documentation, so its basically his word against theirs.
please advise

    I don't really understand this. Even if they changed the policy in May 2007, the claim was in April 2007. So if protected NCD was included at the time of the claim, there should be no effect on NCD.

    Why was the policy 'changed' in May if the renewal falls in February?

    This is assuming that no other claims were incurred in the last 3 years.

    this is what is so annoying, his new insurer is asking for proof of NCD within 10 days!!!!
    we feel like we are not going to get anywhere. it seems that seeking legal advice may be the only answer
