Buyer complaint received - unjustified?

Hiya,
I sold a pair of jeans on ebay last month and the buyer paid me via a method I didn't state into my paypal account (echeque). I didn't say anything and waited patiently for the cheque to clear and then sent out goods.
I since closed down my paypal account and put a request to close my ebay one as I have no intention to do anymore ebay trade as I have flogged everything saleable from my house, and after problems with fraudulent entry to my account I didn't want to leave them open to abuse!!!
I received an email from the buyer yesterday complaining that the jeans didn't fit and that when measuring the waist they measured smaller than the label stated. Of course, she was disappointed. Today I had an email from paypal to say a complaint had been filed for goods received which were not as described on original listing!!! I'm fuming as I described them according to the measurements given on the original manufactuers label, and they were BNWT. I have emailed paypal customer service to find out where I stand as I obviously cannot access resolution centre because my account is no longer open.
I really feel this complaint is very unjusitified, as they were not different from described at all. different jeans fit differently, but it doesn't mean they weren't described correctly. I can only go by the label. I'm now wondering whether a refund can be issued if my account is shut? can they still charge it back to me? I'm not trying to avoid anything, and if I felt it was a reasonable complaint I would refund. But I have done nothing wrong so why should I refund. :mad:

I think this is how TKMaxx get a lot of their stock......items with wrong size on label. Not much help I know.0

thing is its not what I would call wrong size, it was fractionally out from the original measurements like 1/2 inch - inch.Official DFW Nerd #148

walk away, provided that you removed your credit card/bank details from paypal, theres nothing you or they can do
selling clothing is always difficult on ebay, too many women thinking its a shop and try to treat it as such.
besides, aren't clothes different everywhere?, my missus always complains that a size 14 in topshop is way smaller than a size 14 in dorothy perkins.
you sold the clothes with the description fitted on the label by the manufacturer, the end users love handle excess aint your problem!money saving my @rse.

well I just closed my account, I didn't delete any information as I assumed it would be lost when I closed it down. Will they still have access to my details if it is a closed account???

I was well and trully ripped off by a buyer who did a chargeback. I withdrew my card and bank details so they couldn't get the money but I bottled it when they said they would put court charges onto my account.
Probably wouldn't but in the end I just paid it and ended up £70 out of pocket.0 -
Oh gosh!!!! I hope they don't do that to me. I can't seem to work out from reading any of their policies whether she can get a refund if my account was closed prior to the complaint being filed though. Thing is I really need to know in case they just do it to make sure I have the money in my debit card account to cover it. The last thing I need is bank charges on top because it came out unexpectiedly.Official DFW Nerd #148

well, have had the most snotty horrible email off the buyer today calling me all the names under the son and accusing me of purposely closing my paypal account to avoid refunding her. I have the email confirmation of my account closure as proof that I did that days before she filed her complaint, and last time I checked I wasn't a psychic!!!!! I have blocked her emails as I can't be doing with the stress and !!!!!y pathetic comments. Has she never thought that perhaps the jeans don't fit because she has put on a couple of pounds rather than they measure wrong!!! I've had it with ebay. She has left me my first -ive feedback so I have left her suitablly nice comments and I will now be closing my account and having nothing more to do with the stupid place. I only go on there to try and make a bit of money, not for hassle like this. It's things like this that make it clear it is not worth the fuss.
I'm fairly sure that she'll get her refund one way or another, and I will just expect it to come off my card at some point in the next week. I think its bad though, as if my account is closed they should'nt be able to use my financial information - surely????Official DFW Nerd #148

I may be wrong here, but I'm looking at the Paypal buyer protection policy and clause 4(a)-2 states that an item is not considered 'significantly-not-as-described' if:
If you were just following the size displayed on the label, then it seems pretty clear to me that the description was just "reasonably misinterpreted" (either by you or the buyer depending on how you look at it) and you are therefore not at fault.iii The description could have been reasonably misinterpreted by the buyer or the seller. For example, if the item is a different colour than advertised (e.g. the item is aqua-marine but was advertised as teal);
I would stick to your guns with Paypal, and also forward them any abusive messages you get from the buyer - it can only add to your case.0 -
I agree with masonic.
To me jeans are something that you really need to try on before you buy - which is why I would not do so.

Mmmmmm speaking as the devils advocate here..... if the jeans state a certain size and I know that size and brand fits me .. and i buy that brand and size off ebay and they DON'T fit...well.... mmmm I am not suer what I would do. depends on the cost and if the listing said size 10 but would larger/ smaller size !0
