Landlord gave me my deposit back 3 months ago - now he wants to claim some back?!

Thanks for your comments. I suspect that he might try to take me to small claims over it, but seeing as he's given me the money back, surely they won't rule that he can now demand some back! I guess he'd had time to check the place, decided it he was happy and returned it. To now come back 3 months later to say that it wasn't actually up to standard seems so bizarre!
I have replied with a polite email saying that the time frame to raise issues with the tenancy is between me leaving the tenancy and him returning the desposit which has now elasped. Hopefully he won't pursue me further.....
Would you be happy to go to court over this?

Hi Basira if he returned the majority of the deposit at the time you left then that suggests to me he was happy. 3 months is too long a time frame and I would not chase it through the courts as this costs money as well. You did the right thing e-mailing him as if it did go to court you can prove you responded and stated your case for non payment etc.Debts as of 01/june/08

Didn't someone (SubjectToContract?) say that LLs can't charge for the cleaning they do themselves? Also that all deposits (or part of) that LLs keep, should be declared to the taxman.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

Hi Miss Moneypenny if a landlord keeps part of a deposit it will be listed as income but if it is paid out to a cleaning company for example it will be a business expense so no tax is liable. He can do the cleaning himself but then would not have the invoice to provide the tenant with as proof of cost of the deduction.Debts as of 01/june/08

Guys, thanks very much for your help - I have had a reply back from him basically completely backing down - apologising and saying he didn't really expect me to pay it. !!!!!!!!!!
Anyway, looks like a polite refusal did the trick on this occasion. Thanks again for your help - really glad I found this forum! Hopefully I can help others in the future!
