PPI and Definition of Employment

I have two policies which started paying out after becoming unemployed in August 2007.

At the beginning of October, I had an opportunity to do some part-time work, up to 15 hours per week. This was cleared with the Job Centre and with the two insurance companies. I have a copy of the letter I send to the insurance companies.

The part-time work is on a good daily rate, but it means that the Job Centre do not pay me job-seekers allowance. I have to fill in a form when I visit the job centre, declare my hours, and the amount paid. It is usually 7.5 hours a week and never more than 15. They pay my NI credits. I also get the JC to complete 2 ABI1 forms, which I send to the two insurance companies.

The last time I sent the ABI forms off, last week, the Job Centre had not completed each of the two forms in the same way. One form had "Has the customer stopped claiming Jobeeker's Allowance" ticked "yes" and the other form "no". The form that went to the insurer that had "yes" ticked, has caused my claim to be suspended, following investigation.

They have phoned me up several times today claiming that they did not know I was working part time, and the fact that the Job Centre had ticked the "yes" box would mean they would no longer pay me.

I called the Job Centre, but couldn't answer on the phone why one form had "yes" ticked and the other "no", by the same person.

Both policies say they will pay out up to 12 payments. But, what is the offcial definition of unemployed? I thought it was working less than 16 hours a week, whilst actively seeking a full-time job? I have evidence to show I am doing this.

In hindsight, if I had checked the ABI forms at the time of signing, I would not have had this problem.

The only way out appears to be stop the part-time work, start claiming benefits, and get paid the insurance again.

Does anyone have any constructive advice please?

    Is there no way you could get your employer to up your hours so you become a full time employee?

    My employer is trying to build up his business without relying on loans and paying his own way. He has a few contracts at the moment and said there would eventually be a full-time position. However, that depends on the amount of work coming in. He's in the business of carbon footprinting, energy analysis, followed by installation of energy-saving devices. So, a big potential.

    If I stop everything, then it minimises the chance of being taken on full-time.
  • Then technically you are employed and the insurance would seem to be correct in not continuing with payments on your behalf.
