New build. How quick can I move in after NHBC Certificate issued. Law to wait 5 days?

We are moving into a new build house built by Bryant homes, but facing delay after delay.
We were supposed to view the house 20th March 2008. Then move in 28th March. Bryants solicitors contacted ours with this date.
To cut a long story short numerous times the services (gas, electric, water) have supposed to have been connected and they have not been each time they were supposed to have been done. Bryant say it is out of their hands.
The problem is that myself and my wife have booked time of work (and we can not change this time) and are all packed up and waiting to go. The dog is in kennels and the removal van booked (had to pay an extra £90 as the first date fell through).
We have now been told by Bryant the work should all be done and we should be able to move in week starting 6th April.
The problem is that my solicitor is saying by law they can not release the Mortgage funds until they have had the NHBC for a week and so the earliest we can move in will be the week starting 13th April.
Basically if that is the case we are stuffed as we have to be back at work.
Surely we can move in quicker if we pay extra for a BAX transfer or something. Is my solicitor right? How quick after the NHBC is issued should we be able to move in?
Do not know if this is relevant but we are doing a part-ex where Bryant are buying our house from us.

What your solicitor probably means is that he can only request the money from your lender once the NHBC building regulation sign off has come through and it typically takes a week to get money from a lender after such a request. You might improve on this by a day or two but it will depend on the lender.RICHARD WEBSTER

OK, I realise that your jobs might be different from mine, and there's something I don't get, but - why can't you just change your holiday dates?Mortgage started on 22.5.09 : £129,600Overpayments to date: £3000June grocery challenge: 400/6000

I am head programmer for a large nationwide Bed supplier which includes another 4 sister companies. In the middle of a major project to release online till systems across over 1000 shops in June . I am leading the project and need to be hands on as we are talking a few million £ investment in it. As you can imagine was difficult enough just to get the time off now. No way I can change it.
My wife is even more difficult as she is head of a council computer audit team and has top level meetings booked in her diary for months ahead that just can not be changed as relates to people who have their own diaries full and completion dates for projects that can not be missed, so knock on effects etc,
So no can not change holiday dates.0 -
