I won a tracksuit for my dd on th 29/2 and paid via a echeque through paypal.
This cleared on the 11/3 and i haven't recieved the item yet.
I have emailed the seller numerous times this week but have had no commuinication from them even though they are still selling and buying on ebay.
I have now started a dispute through paypal but i do i esculate it to a claim straight away (it has been open since friday. they left feedback for someone sat am, so must know about it) or should i give them more time.
It is only for just under £10 but i feel ripped off.

It is Easter and they may be on holiday, plus the fact e cheques are a nightmare to keep track of if you are a power seller. Are they a power seller, could they be on holiday? The feedback might be automatically sent if they are a powerseller. plus the fat as you can probably see by my recent question e cheques are not that popular!0

Regardless of whether the seller is a power seller or not if they can't keep on top of their auctions then they should limit themselves to a number that they are comfortable with.
OP, escalate the claim to a full chargeback, if they have not repsonded to your email in the past week then that is plain rude..a chargeback will get their attention I'm sure. However if they let the chargeback run you do need to be prepared for a long wait for a refund, I have a chargeback against me running at the moment which I expect to lose..and it is just going into the 5th week!
It is true that sellers don't like echeques but we shouldn't blame our buyers, they often have no control over these blasted things either.

I'd at least give until close of business tomorrow. Playing devil's advocate, not everyone works at the weekend, the feedback they left may have been automatic, mine is. As Soolin says if you escalate it may take ages for you to get a refund. There may be a simple explanation, so a few extra hours won't hurt. I'd escalate it Monday evening if you don't hear..0 -

i am more angry about the lack of contact than anything else. i will wait till the end of today, but i just don't think that they are bothered. they have about 20 due to finish this week so they must be aware of my emails and dispute. i will let you know how it goes.
