Received Notice Of Inteded Prosecution

Hi

Today hubby as received a notice of inteded prosecution for speeding, letter states that he was doing 38 in 30 mph. We have a satnav with camera detection and speeding alert on, no cameras were detected and according to satnav and car speedo he did not exceed the limit, what should he do next. We saw no mobile cameras, we did pass static (yellow) cameras but was always within or below the speed limit, we were extremeley surprised to receive this letter.

    First things first Sat Nav does not have camera detection. The only way the Sat Nav knows there is cameras is waht has been loaded onto the system and needs updated regularly.

    Your speedo will not over read the speed unless it is not working properly (highly unlikely and can be checked against Sat nav).

    So that leaves two options:-

    1. You were speeding

    2. The camera is faulty, lines on road are incorrect it photographed someone gong the other way all of which are possible but difficult to prove.

    I'm sure you will be able to find someone that will help you with these but you will probably need the photographs etc to build any case.

    The first step should be to ask for photographic evidence of the offence.

    The letter will give a location and time and it will say if the camera was fixed or mobile, first thing is were you there at that time? Then you want to get the photographs. Then if you are adamant you were within the speed limit & it was a fixed camera Gatso type, you could google 'notso' for a possible way forward.

    Speedometers can legally over-read but not under-read.

    Most cars over-read, usually by 2-4mph.

    as above,get photos,if it was a gatso you can work out the speed you were doing.

    You missed flashing at a different interval to the legislated specification.

    The two flashes are supposed to occur at exactly half a second apart (500 milliseconds) but they seldom do, even if they have a calibration certificate saying that they do.

    If the camera flashes at 600 milliseconds (and can you tell the difference of 1/10 of a second?) then 30mph becomes 36mph to the camera, 40mph becomes 48mph........

    Also it could be that the area was until recently a 40 zone and the limit had recently been dropped so you thought you were ok but in fact you were not.

    You can try things like pepipoo and notso but i'd be suprised if you didn't end up with 3 points on your license.

    Well first of all it could of been a mobile unit or even a new static camera that had not been updated onto your sat nav system. So just because you did not see it or get notification of it does not mean it was there.

    Also it could be that the area was until recently a 40 zone and the limit had recently been dropped so you thought you were ok but in fact you were not.

    You can try things like pepipoo and notso but i'd be suprised if you didn't end up with 3 points on your license.

    There's a video on youtube posted here in a thread started by tomstickland, that could explain the speed anomaly if it was a mobile unit. And if the speed zone has recently been changed you should check that the procedure followed by the council was correct.

    While the police do undoubtedly use modern technology for Revenue Generation, there is no requirement for any photographic evidence in order to gain a conviction for speeding. The word of a serving police officer is sufficient, and it is possible that:

    1. The police were using Vascar (basically they use a hand-held stopwatch, or even a wristwatch with a seconds hand, to time you between two known places - for example, motorway bridges, white dots painted on the road, etc - in order to calculate your speed).

    2. The OP was followed by a police car, while driving in excess of the speed limit, for a period of time.

    It's also possible that the OP just has an out-of-date speed camera database on their SatNav.

    (Personally, I use a SatNav with the latest speed camera database, and a Valentine-1 radar/laser detector. Neither of these are as good as using good old-fashioned observation and common sense!)
