Inventory worry/ramble

Wasnt given an inventory for my last flat even though they said they had done one and they would contact me when it had been printed, they didnt so i called them a few times but was just told that they would let me know when it was ready, moved out now, have recieved moveout inspection report and its full of things that were there when we moved in, where do i stand on prooving this?

oh and the flat is now in a better state than it was as they didnt have it cleaned before we moved in, they said they had but it was obvious some one had jsut done a quick sweep (moved a wardrobe and found more dust than a dyson could handle and a sock)

whoever did the check obviously hasnt checked against the original report (if there was one) as it says they did.

    A wise LL/LA should have an inventory signed by both parties to the contract - if you haven't been given one, then clearly you haven't signed one.The LL has to give you a breakdown of any deductions they want to make, and they'll find it difficult to prove anything without a correctly executed inventory.

    Did you tenancy start after April 6 2007, ie was your deposit registered with one of the schemes?
  • yeah we moved in in sept last yr and made sure it was protected, they havent sent a list of deductions, just stuff that they think is wrong though it was like that when we moved in, and thinking about it they claimed they did a video inventory, def never saw or signed anything

    write to them and ask to return your deposit within 7 days.
  • ive written a letter stating with my comments to their inspection, should I put at the end that I would like the whole deposit reurned within 7 days?
  • have just rung and asked for a breakdown of what they want to charge as there wasnt one witht he inspection report

    Good move - keep it calm and polite, and be persistent.:smiley:

    If and when the LL/LA says what they want to deduct ,and why, if you don't agree then you should let the Deposit Scheme know in writing that you are in dispute. You then either proceed to arbitration (if LL/LA agrees to do so) or you go onto the small claims court. The LL has to be able to provide appropriate evidence of the state of the property.
  • still waiting for them to call back, will get them to send deductions list before i send off my comments and see what they say

    its things like they are trying to blame us for a loose door handle that was loose when we moved in and apparently they cant find the electrical manuals, well they obviously arent doing a good job cos they're in the same kitchen cupboard that they were in when we moved in so i know they're not marking against the last inventory. they're also saying that we touched up areas of paint withthe wrong type of magnolia(is there more than one magnolia) when they are the ones that had the painting done before we moved in.
    its full of discrepancies like that that show they are not using a previous inventory, grrrrr

    if i vent here i should be calm when they pull their finger out and call, aghhhhh

    tried calling the estate agent again this morning and guess what.... the woman i need is busy and she will call back later, surprise surprise no call, so ive emailed asking for a list of the deductions they want to make and included my number AGAIN just in case the post it note the other people in the office have written it on has magically disappeared

    ive also emailed the dispute service they are registered with to ask for advice as it says on the dispute form that i need to include a signed inventory but i dont have one so will see what they say, may also try and book into citz advice before i go back to work next week, so much for a relaxing time off.
  • dispute service have said that i can start dispute without inventory, just need to write on form that i didn't get one.

  • finally someone has bothered to email me apparently they had some really difficult cases to deal with and havent had even a few mins to call me, anywya they said that i need to send off my letter with what i feel was wrong witht the move out report before i can start a dispute or they will discuss what deductions they want to make
