Potentially Uninsured driver

Hi,

A driver pulled out on me at a T-Junction, I have reported this to my insurers and a group called Accident Exchange, the girl I have been speaking to at Accident Exchange says that the drivers details do not match the insurance policy. God knows why but I only managed to get the name and the reg of the driver, but I did manage to get a photo of the other driver and the other car. I have sent the photos to Accident Exchange and they say the will contact the 3rd party insurers with this information. What is likely to happen now? Will I have to pay for the damage to my car ? I have contacted the police but they say as the other driver gave me a name and details then that is legal and they cannot do anything more about it ?? Is that correct ??

    You have to say the car is yours, but i've used it quite a few times.

    What happens now, depends on what level of cover you hold yourself. I am assuming that as far as you know the details you were given were not false?

    The claim will depend on who was at fault. Your insurer (if you are comp) will attemp to recover the loss from the other insurer. If the driver was not a named driver on the policy, the other insurer will attempt to not pay. It will then be down to you to recover your losses yourself (or with the help of a legal assist company/policy).
    You can either claim against the MIB Motor Insurance Bureau (they should be able to advise if they will obtain the missing information for you or they may suggest ways for you to obtain the missing info)
    or
    You can ask the DVLA for the details of the vehicle owner.
    You can then write to the vehicle owner for the full details of the driver.
    You can then claim against the driver directly.


    The driver is required to give you their address, so strictly speaking they have not fully complied with the law. You should go back to the police and ask for their assistance to prvide the address of the driver and ask them to investigate if the driver was insured - if so by whom, if not then to prosecute both the driver and the vehicle keeper.
