I do know that it is usually very tricky to do much about - they usually put things/clauses in the lease that basically says they can do and charge as they please and it's very difficult to get around because you would have signed the lease...................sorry but HTH.

Hi Nealallen

Below is a general box which shows the likely clauses in a commercial property lease. Most might apply to a house or flat. Do you have specific concerns?

Rent
• level
• frequency of payments in the year
• in advance or in arrear
Rent reviews
• frequency
• hypothetical usage
• actual or hypothetical term, if any
Statutory obligations
Dispute resolution

Occupational lease Terms etc.

Repairs and maintenance
Insurance
Service charge and renewals fund
Use or uses permitted
Landlord’s consents to tenant’s
• assignment
• subletting
• surrender
Tenant’s:
• mandatory improvements
• voluntary improvements
Statutory obligations
Rates and taxes – liability of the tenant
Arbitration or other dispute resolution procedures

Bear in mind that Acts of Parliament affect residential, commercial and agricultural leases. An Act is likely to relate to specific leases or terms etc.

Hope this helps

If it's a residential leasehold you'd be better off contacting Lease for advice.

MOVING THREADS FOR BETTER RESPONSES

Hi, Martin’s asked me to post this in these circumstances: I’ve asked Board Guides to move threads if they’ll receive a better response elsewhere (please see this rule) so this post/thread has been moved to the House buying board, where it should get more replies. If you have any questions about this policy please email abuse@moneysavingexpert.com.

• We still haven't heard from OP the precise nature of the problem and nobody is going to be able to give any pointers/suggestions etc without knowing some more detail.

Is the property a house or a flat? Is the landlord doing something you don't like or not doing something you think he should do? What is it?

As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.
