    Well, even if they CAN just turn up and take the car - why on earth don't they do it at a reasonable hour, rather than scaring the !!!! out of people and making the whole situation worse!!!

    If they are entitled to take the car they will uplift it with or without the keys.They will get a breakdown motor to recover the vehicle.
    Do not give the keys to a complete stranger without paperwork to prove that he can take the vehicle away. My mother recently had two chancers at her door who stated that they were there to take the caravan away. The caravan is in her driveway but belongs to my sister. She said no that they could not take it but bold as brass they said yes that they were there to collect the caravan but she sent them packing!
    If you feel intimidated dont think twice about phoning the police...yes it is a civil matter but they will attend and confirm the males identity.

    What I can't believe is that not only was it in the evening, but on a Sunday evening at that, surely waiting one more day wouldn't have hurt, or is repossessing a car more important than a day of rest? :confused:

    Hiya

    It actually happened tonight [Monday evening]. I am going to get straight on the phone tomorrow and see if i can get anywhere but it's not looking hopeful since Capital Bank won't make any arrangement with me and the car is two months in arrears. I was hoping they would maybe freeze payments for three months [fingers crossed i'd get a job] or maybe accept less and let me pay the arrears over the length of the agreement but they haven't responsded. I'm taking it to mean that if they are sending debt collectors they aren't going to accept any kind of agreement.
    I actually think they might need a court order as it's in the residents car park but maybe he is trying to bypass that step or maybe he's just trying to make the process more simple for all concerned and they are entitled to get the keys from me.

  • Sorry OP I'm 2 hours ahead of UK :o , been busy doing lots of things and didn't notice I'd gone into tuesday, hope you get things sorted tomorrow.

    If I was you I would make every effort to find out exactly who this person is and who he is working for,not from him direct but find out from the bank who they give the work out to. If you feel brave enough if he has been ok phone his mobile and ask all these questions. Fully read the terms of your agreement and if they are within their rights to take the car back you would be as well handing the keys over.I hate to say this but if you refuse and they have they have to go to court and/or get a breakdown to recover the car, they may add the costs on to your debt.

    I presume that will be to stop you moving it before he comes back tomorrow with a tow truck - that's a low trick!
