I would be annoyed to not be given a refund in these circumstances too. I would write to them and complain about not being offered a refund when they sold you an item which was faulty.*Don't let the b******s get you down

They should have given you a refund,not expected you to do the fetching.Anyway,now you know what the law says,should be ok.I do find these games stores try it on.0

Well, realistically, if you have now come home, posted on here and are considering writing a letter to their head office to pursue the matter, you will probably spend more than the half an hour it would have taken to walk anyway.
I know that it's the principle, but bear in mind that they are not inconvenienced at all by you having the faulty game and not replacing it, and the limit of their liability will be to replace or refund. All you are doing is depriving yourself of the working game for longer by asking them to resolve the matter, and in terms of your legal position, I would have thought that their clear intention to remedy the situation shows that they don't actually intend to deprive you of the product, just that it wasn't handled in the ideal way. Surely even if someone had gone over to pick it up when you were there, it would still have involved the half hour delay?
Did you ask them whether they could have the replacement game sent over from the other store so you could pick it up at a later date?0 -
I completely see the OP's point. The problem isn't the additional half an hour he will have to take, it's that he's being asked to effectively deliver stock to the store, because of what (in the eyes of the law) is their mistake! Of course the shop can't magic the game if they don't have it, especially if it's pre-owned, but surely the shop can either arrange for it to be delivered from the nearby shop, or credit the customer with a refund or vouchers so he can get the game at his convenience when he's next passing by.
The fact that the two shops are so close by should make it easier for the shops to arrange delivery. Not make it easier for customers to go and fetch items for them which they don't have!By replying to this post you are agreeing to my Terms and Conditions which state that I am correct0 -

I can sympathize with you OP. My girlfriend visited junction 32 in Glasshoughton yesterday and picked up a copy of Guitar hero: Rocks the 80's for me from the Game store there. She had bought me Guitar hero 3 last week and I really enjoy it and as a fan of the 80's I thought this game would be great for me. When she brought it home and we opened it they had put a preowned copy of Guitar hero 3 in the box by mistake and as they seal them in store my girlfriend did not realize until I opened it at home.
We took it back to our local Game store today (as the junction 32 store is over 20 miles away) and they claimed they could not give us the correct game as there was no way for them to send the copy of guitar hero 3 back to the other store and if they gave us a copy of the game we wanted they would be down a copy. We were told that we would have to return it to the Glasshoughton store for an exchange and she then accused us of playing the copy of guitar hero 3 (we informed her that it was a pre-owned copy as evidenced by the "pre-owned" sticker on the instruction manual and the numerous scratches on the disc she was still however eyeing us with clear skepticism)
We explained that a similar thing had happened to us once before and they exchanged the game at that time but the girl on the till was ademant that we would have to go back to the Glasshoughton store to change the game. When we asked to speak to a manager she disappeared for five minutes before returning, swapping the game and giving it to us without saying a word.
My advice would be to persist with companies like Game when they are clearly in the wrong. To everyone saying the OP should just go to the other shop that really isn't the point they have a duty to rectify any problems that are their fault as they could not provide the OP with another game a refund should have been issued. I feel that many employees in places like Game are told to say no to a customer for as long as they can before the customer stands up to them (quoting the sales of goods act for example) which is why I do not blame them but I will defend my cause if I know I am in the right.0
