    I think the IR would very interested to hear about the £8,000 fittings, especially when they include laminate flooring.

    Have you checked to see if there actually was another 'buyer'??:rolleyes: sounds like a big con to me, and if there is another buyer than more fool him for agreeing to the ridiculous 8K. You are well rid. Count ya blessings!:T

    That's terrible - total and utter greed. The house is probably worth about half what it was on sale for - hope it all goes horribly wrong for him, he loses his sale and he's stuck with it.

    What does your solicitor say about it? Is it legal to add estate agent fees? I suppose you are best to just move on and forget about it, but why should he get away with it?

    People like this often show their true colours early on. The invitation to a contract race was a big red flag. It's a clear sign of someone with little integrity and shows that they are prepared to see people unhappy and out of pocket. Never enter a contract race. A deal can be agreed with one buyer without problem.

    I'm sure HMRC would be interested in this sort of thing. It's not illegal to pay EA fees for a vendor but if it's based around a property sold at £250,000 then of course, it does look like tax evasion. I'm surprised that a solcitor would be happy to go along with it even.

    I was thinking £8k for f&f for a house @ £249,999.99 may raise a few eyebrows at HMRC.
    "Mrs. Pench, you've won the car contest, would you like a triumph spitfire or 3000 in cash?" He smiled.

  • Flooring is considered as part of the fabric of the building. I'd like to see the expression on the tax inspectors face when he sees this lot put before him

    The £8K for fixtures and fittings should have been oulined in the letter confirming the offer issued by the estate agent. May be worth asking the EA why it wasn't included. Either way you would be going to exchange contracts with a vendor and EA who had forgotten to mention £8k, what else may they do as the purchase progesses?

    We paid £250,000 for our house and a bit for fixtures and fittings (not 8k though!) and when our vendors completed the F & F form the values greatly exceeded the agreed amount. When we queried it with the EA they said the contracts would be written up with the agreed amount but the vendors just wanted us to know what a bargain we were getting! We had negotiated them down quite a bit by playing the stamp duty game and I think they wanted to make a point!

    In England & Wales the fixture & fittings list is nothing to do with the estate agent, it comes from the seller's solicitor. An exception maybe when the offer is conditional on certain item(s) being included in the sale price. Even then it would be followed up by a fixtures & fittings list from the seller's solicitor.
