No mate not at all. I appreciate all input on this. I will write to them and see how it goes.
Cheers
What I am thinking is they may reply with something you can use to your advantage. Ideally they may reply saying the phone was not in your name, then you will have something to work with.
Or they might reply saying they didn't contact you as you weren't responsible for paying the bills.
With a bit of luck they will say something that shows the debt not being paid was not your fault. Might help with a mortgage application if you can show that you never knew the debt had not been paid. Or that you were never sent the bill in the first place.
It won't matter to a computer, but if you get to speak to a human and can say "look, I've paid every bill/DD except this one, and this letter shows the money didn't come out of my account and they never told me I owed the money. " It just might help.0 -

I like your thinking. Have always paid my way and even when I ran the business I paid everything up front.
Cheers mate.

Well.. This was starting to cause me problems so I have paid it off and am now seeking advice about reclaiming the money via the small claims system.
3 uk were not sympathetic at all. As far as they were concerned it was my bill, which I suppose they were right to assume as it had my name on it. Anyways they have had their money.
A couple of things though for those that know these credit reference agencies and how they work.
In experian they had the debt registered at 519, yet 3 uk only wanted 475? Can someone shed some light on why the discrepency?
Also my credit report still shows the debt as unpaid even though experian have notified me that a settlement has been paid. Do they take a few days to update their systems?
Thanks all for the kind words and all your help.

May take a week or so to update, have i read you original post correctly?
Is there an actual default on your credit file or just missed payments?0 -

It is a default, Account closed because failed contact. Experian rated it with a big red 8 wwhich I assume is not good.

An update for you all. After a bit of to-ing and fro-ing with letters, much to their disgust as they wanted me to use email, however I wanted something in black and white in case I needed to go legal with the matter.
3UK are going to remove the default within the next 30 days! Ok it's cost me the 500 pounds but hey compared to the penalty on a mortgage it's worth it.
Here's hoping this goes smoothly.
