Help please. Ex partner has blotted my clean record.

Hi all. can anyone help me? I am so annoyed at the moment. :mad::mad:

OK here's the outline. I ran a business and employed my ex partner (partner as in we lived together). We both had mobiles for business use, both in my name as it was my name on the business. When we split she agreed to take her mobile over as I decided to cease trading and go back into full time employment. She, to my knowledge had it transferred to her name and direct debits from her personal account. Apparently not so. All she changed was the bank account so payments were taken from her personal account.
I have just done an experian search on myself and she has defaulted on a payment on the phone to the tune of £519 back in December 2007 and hence blotted my record. I still have my mobile and still on contract with the company without any missed payments whatsoever, and yet they have never contacted me about the other one??
I was alerted to this as I have just gone for a mortgage and failed at the preliminary check. This is the only blot on my records. I really want to get on the housing ladder.

What can I do about this? Do I take it on the chin that I have been stuffed over and pay it? Or is there another way?

    A default will last for six years although some companies will tend to view them less harshly after a few years.

    Has the outstanding amount been paid?

    I don't have a mobile phone, never have, so tell me to bog of if I'm wrong.

    Can you really transfer a phone contract that is someone else's name to your name without them having to agree to it in some way?

    I think that unless you have proof it was changed to her name you are stuck. The phone company will say it was never changed to her name, and it would not be possible for her to change it, and all you have is her word for it.

    Contact the phone company and find out why they did not contact you. Explain the situation, and see if they will agree that the default is not your responsibility and notify the CRAs to that effect.

    In any case, write a note explaining the circumstances and attach that to your file with each CRA.

    No I have only just found out this evening. the amount is still outstanding.

    If they have authorisation to act on your behalf with the phone company, as she did, then yes.
    In any case, write a note explaining the circumstances and attach that to your file with each CRA.
    Will be contacting the company tomorrow. Am still a little angry here as you can imagine. So won't do it tonight. Oh.. Whats is a CRA please?

    You can transfer ownership of a mobile to another person but it requires permission from all parties.

    Which mortgage company did you apply to?

    National & Provincial. Done through an independant advisor.

    Hope you manage to sort it. All may not be lost, a friend went direct to the Chelsea when he was having problems.

    I not promoting them and i don't know your circumstances but may be worth looking around.

  • I know of somebody who would have lost a mortgage offer over an unpaid mobile bill of £27.
    He was so pig headed that in the end the mortgage adviser offered to pay this for him (presumably would have got a lot more back in commission!).
