Thanks for all the comments. I swap my car usually on average once a year have never had a problem with deposits in the past. I fetch cars from around the country and it was the garage who asked for the deposit and set the amount at £300. I can't afford to loose this sort of money which is why i was reluctant to put down this much. I wanted to try and find the same model locally to test drive first to avoid travelling over 100 miles in case the vechils wasn't suitable or couldn't fit the car seats in it. If he had stated the deposit was none refundable I would never of paid it in the first place. i have also offered to deduct the costs for him to advertise the car from the deposit. i have been in touch with trading standards and they are taking my caim on so fingers crossed!!!:p
And whilst the car was retained the seller couldnt sell it
a deposit is just for reasons like that, you clearly dont understand what a desposit is if you think they are refundable
Why should a dealer, lose his cash flow whilst you shop around

so you are saying if i had sold mine got there intended to buy the car but there were scratches in the paint work or my childrens car seats at over £100 each didn't fit I still wouldn't be entitled to the refund?
Who parts with £12000 unlikely? I never agreed to purchase a car the intention was to test drive and inspect it. If i didn't like the car are you saying i should expect to pay £300 just to have a look and take it round the block? I could of gone and test drove it knowing full well i wasn't going to but it but pretended not to like the car !!!!!:mad:0 -

Having car seats that don fit is not really his problem, you can find guides on line as to which car suits your car seats.
You are entitled to a refund if the car is not as described, or has area's of damage that were not disclosed.0 -
As an ex motor trader I lost several potential sales by taking a deposit from potential buyers only to be told several days even weeks later that the customer had decided not to buy for whatever reason , but always after thoroughly testing and agreeing 100% to buy the vehicle.
This meant having to waste time and expense to re advertise, and to convince buyers the reason for the re-sale was genuine. Plus to the smaller traders to make a living they must have a quick turnover so this in effect loses them a weeks wage!
If the deposits were refundable , the buyer could go around locally securing all the best deals until they made their mind up, picked one, then return to collect their deposits!!
The trader is not always the bad guy they must earn a living and support a family!!0 -
I totally agree that once inspected and tested i shouldn't be asking for my deposit back. My whole point is there were only 2 days between the deposit being paid and the buyer pulling out of my sale. he was the one who had test driven my car agreed the price then waited 2 weeks before deciding he couldn't get finance. I feel i am being pefectly reasonable to request at least the refund minus the re- advertisement fee. The car was never removed from auto trader site anyway the car was only 12mnths old so no mot i asked if a service would be done but told car was serviced prior to him taking stock of it so no. What exactly had the trader lost? even re advertisment fees are £20 for traders for 2 weeks. He even stated in his own advert he was not responsable for any details different from his description and it was up to the buyer to confirm these prior to purchase. I did ask him for part ex but it was £2000 less than i was offered for the original sale.
The whole point I feel let down by is HE SAID the deposit was fully refundable or i would never of paid it took the chance that the car was sold to someone else.0 -
I get the feeling that you've grasped the concept of the deposit system and it seems that you were unlucky to have dealt with someone who , shall we say is not true to his word, in saying that the deposit was refundable.
But as previously mentioned you will have to prove this was agreed (unless you have it in writing???)

Its not the dealers fault you jumped the gun
As long as the car is as described you don't have a right to the deposit back unless you can prove what he said
Why is your offer reasonable, for all you know someone could have bought the car the next day and your abuse of the system prevented that
If you dont have the cash you shouldnt be buying
You could claim for damages against the person who pulled out of yours, but you have an obligation to minimise your losses and purchasing before you had funds would screw that0
