Do I still threaten court action

Hello
I wrote my letter to the bank a few weeks ago reclaiming bank charges but of course have received no reply. I did send the letter that states I am having financial difficulties and requested them to look into it now rather than after the test case but have received nothing at all back from them. The question is - do I now send the letter threatening to take them to court or will I have to wait till this test case has finished before I can proceed any further?
