Just found out car I've bought was a write off

    Seconded, that is a fabulous series of letters, no wonder they offered the refund after the 1st.

    Some great letters but I too would of taken the £5,200 purely to avoid the delay in getting the extra £200 and avoiding all the grief.

    I would of then been tempted and given my kids brillo pads and asked them to clean the nice mans cars for him:rotfl:

    I just bought a car from a private seller. He did not disclose that it is a Cat. C write off, even though I asked if it had ever been damaged, he replied 'no'.
    He would not let me see the V5 document (I didn't know I should have been shown it), so I didn't sign it either. Therefore, he deceptively stopped me from seeing the special notes declaring it as a write off. He just presented me with a pre-torn off section 10 (new keeper's temporary V5). I know alarm bells should have rung, but they didn't, as I am so inexperienced with all this.
    He told me he was selling the car for his son. the V5 document was returned to me by DVLA in my name - it has a Yorkshire address and the seller's address was Essex - and there was the info that it had been damaged/repaired at some point.
    I am so upset that he has sold this car by deception and perhaps fraudulently. Does anyone know if I have any recourse?
    I have written today to the DVLA about everything.

  • Car sold not as described. Return it and demand all of your money back. Involve trading standards regardless of outcome.

    Do not give them the V5 until the money is back in your account - just as you would if you were selling it.

    Its fraud, pure and simple. If they lied to you about this, what else haven't they told you?

    The car will likely be perfectly safe to drive, however you didn't want a Cat D car so you don't have to accept it.

    Private seller means you have little protection, fairly sure there is very little you can do. I would start a new thread TBH.

    this is why i would never buy a car without a HPI check first... never hand any money over until you are satisfied with all the details

    i learned this 1st hand as i had a similar problem once, i put a deposit on a car then found out it was category D afterwards, i put a deposit on it so that the RAC could do a veichle check on it, after i found out i still decided to go through with the veichle check but apparently the damage wasnt repaired very well and the RAC man basically said he thought it would be better to look elsewhere as i might be taking on a potentially dangerous car (may not hold togetehr well if in another accident), im just glad i didnt buy the car, it was only a deposit, but its better than buying a potentially dangerous car.... i consider myself lucky in that sense, and when i bought a new car eventually the 1st thing i did was HPI check it!

  • Sorry I didn't ever provide the outcome (not long had a baby so other things have gotten in the way :D)

    Anyway the outcome was I got all of my money back :j I think the tipping point was when I advised him that I was going to come down every weekend with a big sign saying this garage sells write-offs and was going to keep on doing so until I got the message through - I think it also helped he had a call from our local paper asking if he was aware I was planning to start my protest that weekend and they would be interested in an interview with him :rotfl:

    Funny enough he then called me and said he'd had enough of my p**sing about and I could have my f'ing money back :T

    I was tempted after I got the money back to go down anyway but made do with the fact that when I dropped the car off there was about 10 people looking at cars and I was shouting I'm returning the writen off car you sold me :rotfl:
