Rossendales

I'm paying Rossendales money back for a default on council tax.
I'm paying them £5.00 p/w and the oustanding balance is +-£300.00.
I set the D/D up but made the reference Rossendales instead of my account number.
Rossendales sent me letters of demand for the outstanding balance to which I have informed them I am making the payments and they should check their bank account.
They have replied and stated that they want £25.00 p/w Not £5.00.
How do I stand on this as £5.00 p/w is all I can afford to give them (only want to give them as I use the other disposable income on more important debts)

  • I am repaying council tax arrears with Rossendales (very bullying) using giroslips.I rang them last week tosee how much my balance was and they informed that each payment I made on their giroslips costs me extra! (ill hunt the amount out and post it on here). Surely this is wrong? Ive been trying topay £25 per week but have fallen behind and am dreading their next letteror action.
    Im going to ring them again on Tuesday and see if theyll accept lower amounts or a monthlypayment.

    "Debt collection guidance
    Final guidance on unfair business practices
    July 2003 (updated December 2006) and they have calmed down.
    They still say £25.00 is the acceptable amount to pay and I've asked them to justify where it states that as all I can afford is £5.00 aswell as an up-to-date statement of all transactions.
    I'll let you know how I get on.

  • Hi, I cant find anything Ive signed with them. Id asked on a numberof occasions to repay a lesser amount each week and if I could pay monthly but they flatly refused.Ive missed payments before and 'caught up'atthe end of the month and no further action was taken.

    Forgive me but I have never understood people stating that "they refuse to accept a smaller amount".

    If you sent what you could afford --what would the company do?? send it back??

    I am assuming here that there is no court order because if there was you would probably be paying what you could afford and not a silly amount.

    Therefore if you pay what you can afford & they dont find it acceptable-- the next thing they can do is take you to court::

    If you are paying a regular amount, they are hardly likely to take you to court as it costs them money & they would probably end up with the repayments you are already making. Also the court would look at your income etc & make a judgement accordingly which would be "what you can afford"

    I know what I would do.

    This occured because I bought a flat and it was vacant for 6 months before I found tenants and I was unaware it was vacant for 6 months prior me buying it.
    The council only allow 6 months free in any year.
    They took the necessary action and that is why Im paying the arrears.
    Herbie21 I can not remember if I receive confirmation or not. I think they told me how much they wanted me to pay. On the other hand if they did I dont know why Im paying the £5.00. I dont recall signing anything.
    I have sent them an e-mail requesting a balance and statement of all transaction and correspondence.
    Balif has not been around and I do not have a "walking"

  • Thanks Herbie. I know it sounds extreme but is it too late to ask if Ican have this debt paid via an attachment of earnings? I have done this in the past. My credit rating is completely sunk over other bad debts but Im in the process of sorting everything out.

    Would they not have to apply for a court order before bailiffs went in?

    This is the latest after numerous email and correspondence I 've had with them.
    Rossendales Ltd is a certificated bailiff company, governed by the Enforcement Services Association and the Council Tax (Administration and Enforcement) Regulations.

    We are under no legal obligation to accept instalments, and agreed to what we believe to be a reasonable instalment arrangement based on the information we hold.

    If you would like us to review your instalment rate, we require a full financial statement with proof of all household income.? Until we receive the necessary information, payments must be maintained at the set rate of ?25.00 per week, in order to prevent us proceeding with the next course of action.
    We note from our records you are in the process of contacting your bank in respect of missing payments made.? In an effort to assist, we will reinstate the arrangement previously set of ?25.00 per week.
    Payment details will follow shortly.
    This is what I sent them:
    I have noted your comments and would like to draw your attention to the:

    2.6 f. pressurising debtors to pay in full, in unreasonably large instalments,
