Short term illness/employer harrassment

Im one of those people that will only go see a doctor if Im on deaths bed. Ive been off work ill for only 2 days and my employer has already been in contact with me 4 times. He has been saying that due to the doctors not being open due to the Bank Holidays, I should go to the hospital. I suffered from the same condition about 8 years ago and in total, Ive seen about 5 or 6 different doctors and none of them knew what is was. So I feel there is little point travelling about 15 miles to the hospital with all the costs involved when I am fairly confident of what they will say. Im normally able to return to return to work after about 4 days so there is no need for a doctors certificate.

P.S. The last time he phoned me the conversion ended "hope you feel better soon!" then hung up
Bank charges reclaimed: HSBC £1990

2007 Competition Challenge: Target £150
So far...£373.48 (MS Office 2007 Professional Edition) and a rizla tin

Why does your employer want you to go to the hospital? Is it to get help or to get a medical certificate?

If it is to get help, I don't think they would welcome you in A&E if it is neither of those things. If it is for a medical certificate, your employer should only ask for a doctor's statement after the first seven days in a spell of sickness.

Sorry. Where I was so annoyed at the most recent phone call I totally forgot the question.lol.
What are my rights about this and is demanding me to go to the hospital unreasonable?

He seems to think that if the doctors are closed you go to the hospital.

An employer can request a med cert for short term absences (a private note can be issued, and it would be reasonable for the employer to pay for this). They would normally only do this if you have had what they deem to be an unacceptable number of absences.

I agree about A&E, they would probably send you away with a note for your employer telling him to stop wasting their time! x
    Gone ... or have I?
  • I also see this as a form harrassment from the employer. If you have a union in your workplace get them to take this up.
Most places I have worked have a policy only to call when you are on sick leave if it is long term.
Does your employer not just get you to self certify for the first week as I am sure this is the correct procedure and should only ask for a doctors line if it is more than a week or if it is a continuing illness that is causing quite a high number of absences.

much as your employer strops about this they cannot force you to go to a hospital or doctor if you have been off for less than 5 days, unless like somebody mentions you have gone over the maximum allowed days/occasions of sick leave.

my last employer did my head in about this so much i went down to my surgery, asked the receptionist to photocopy the note in the window explaining about sick notes, and took it in to work to show my manager. perhaps you could do this too :) it shut them up pretty quickly!

If you want to keep your employer happy (and I do think they are harrassing you!) you could maybe ring NHS Direct and explain the situation to them - if you could put it so that they agreed with you that going to A & E would be ridiculous, then your employer would have even less of a leg to stand on.....
