thank you to all for your replys ..sorry for delay but have been away working. Have read all the stories and watched the videos - thank you - very enlightening. I have contacted an attorney friend who is giving me advise and we will probably lodge a formal complaint with the FOB. For those asking - it was Natwest Bank that is refusing to pay up.

Will let everyone knows what happens - but looks like if it goes to the FOB, it could take up to 6 months.

You are now on the right track. It should not matter how long it takes, the point is for your hard earned money to be returned to you.

Sorry to ask, why should you have to pay for the money that you haven't spent? That will simply mean the crooks enjoying their ill-gotten money and lifestyle at your expense.

Chip and Pin technology is not a water tight, infallible technology. You should not have to be penalised for a flawed technology that was hurriedly introduced.

The hefty sum of £2500 is not to be sniffed at and wished away by any means, more so, as you did not spend it! Please persevere till a more positive outcome is achieved, hopefully.

This is wishing you all the best in your fight for justice and fair treatment with Natwest.

    Suggestion:

It maybe worthile asking your attorney friend if it's worthwhile going down the Small Claims Court route as NatWest have failed to comply with the Banking Code. You may get a quicker result.

As for PIN advice for those who've been victim of PIN based fraud.

I bet not one single card issuer has offered any sort of PIN advice to a victim when their PIN and card is used fraudulently. In fact it's been reported that they issue new cards (great) that work with the Original PIN (not so good), and nowhere is there any mention of Chip & Signature Cards for those who've lost faith in PINs or don't feel safe using PINs.

Once again good luck and keep us all posted.

    Natwest Again....

I too was the victim of debit card fraud last August when I had my debit cards stolen from a locker whilst using a gym at a private hotel/leisure centre.

Within 25 minutes the thief had driven 4 miles to the local town and withdrew £250 from an HSBC cash point and then walked into NatWest and withdrew £1800 over the counter, without having to provide any identity.

Natwest say that I must have been negligent and that I must have made the pin number available to the thief, this is not the case as I have never carried a pin number in my life.

Natwest will not abide by the banking code as stated in the code that they have to prove that I was negligent with my number, in fact I believe they were the negligent party by giving such a large amount of cash over the counter with no proof of identity, yes...no passport/driving License required.

This is totally unacceptable bearing in mind that I can't draw any more than £250 on a debit card from a cash point.

When I questioned the bank they said that they could give up to £5000 over the counter with no further identity......this policy still stands.

Natwest can't even tell me the pin number that was used..it's so obvious that pin numbers can be read or copied/scammed (there are too many ongoing victims currently) , let's face it the cash point reads the number on the card, I have also been issued with a card reader from Natwest that confirms and reads the Pin number, do we really believe that the system is unbreakable.

I have been with the bank for 18 years with a perfect history.

I have never carried a pin number, it's an insult to my intelligence to claim that I can't remember a four digit number when I can even remember the 12 digit number on the front of the card without looking.

The Financial Ombudsman have had my case since October saying they are too busy to assign it to anyone yet.
