Thank you vetfred for your detailed reply. To be honest, the same thoughts had occured to me, although I did not think of him getting a witness statement at the time of the incident, it simply wouldn't have crossed his mind to do it though. For us, it just seems strange that he has never had a shoulder problem before, and now, nine months after the incident, the shoulder that he hurt then is causing problems now. I do accept what you say though, thank you all for taking the time to reply :)

I've spent time in a solicitors personal injury department seeing some pretty bad things caused by negligence on a company's part and have also been on a bus when a person was thrown into the luggage area because the driver was speeding and not paying any attention - braking at the last minute even though it was clear there was a traffic jam ahead. I suppose because I knew a witness statement was important should that person wish to make a claim, I offered to provide one and took the driver's details because the person had to get an ambulance and clearly the driver was to blame.

Though he would have had a clear and good claim at the time, I honestly feel it's very unlikely there's a decent chance of compensation to cover any impending costs related to this injury which is sad, since it may well be related and he clearly was involved in an accident.

If you decide to pursue on a no-win-no-fee basis, I believe you should be aware that you may be liable for the other party's legal costs should you lose unless you are covered by insurance against that eventuality and a medical report may have to be paid for or court fees for example if it got that far.
