Got my new tenancy agreement today!

Well, I got my new house.(with help from guarantor)
Got a copy of the tenancy agreement today to look at and Im so relieved that is has nothing in it about informing the LL if I go BR!!
Fingers crossed for a nice OR!

We move in 7th April (lucky 7 I hope!) so can start getting new phone line and utilities and other stuff sorted out.
Then can take the plunge and go for it!!!

Paid nothing this month so the house fund is looking ok, the phone has started ringing though, Im sure Ive got more of that to come, may change my mobile number?

Roll on April!

    Oh...am I still at the mercy of the OR?, I mean if im not in arrears and the agreement does not mention BR, Can they still tell the landlord 'just bacause they can' this really is my only BIG concern/obstacle to get over as its a roof over our heads!!!

    Has anyone had the LL informed and if so why?

    Hi everyone.

    I went BR on Friday (didn't want to but circumstances have forced it) and the OR has said that they aren't going to tell my landlord even though there is a BR clause in my agreement as I don't owe any money to them and I have an Assured Shorthold Tenancy. Not sure why this matters, but it's good as far as I can gather.

    hi everyone,

    it seems that there are some nice OR out there who understand peoples situations. As you say why tell the landlord if you have no debts to them and can afford the monthly rent..What is it going to change if you or the OR tells them.

    I have just decided today to go BR, Cancelled all my DD's and payments for coming month and have booked to view rental flats/houses on sat and tues...damn easter weekend.

    i have read the info i got from Estate agents on rentals and as long as i can provide bank info, rent upfront and deposit along with references from employers should be no problem with renting (i hope)...i think i will pull the plug on house phone if still in house come 1st april to stop debtors asing why i havent paid them this month...luckily i have changed job and new work mobile since contacted them last so no-one has my number...which i think would be a good idea to change no. or get new PAYG if on contract at present.

    good luck cmd:0...where did you rent house from is it private or Estate agent etc?

    This seems to be a grey area as before i went BR i read several peoples accounts of their OR interview and they had been told by their OR that it was their duty to inform the persons LL regardless of whether they were in arrears or not and that it was at their (OR) descrection whether or not to inform the LL. SO when i had my OR interview i had already sent a covering letter with my tenancy agreement asking them to please not tell the LL as that was the last thing we needed and he said it was not their policy to inform the LL anyway, the only time they would contact the LL was if you were in arrears or you couldnt/wouldnt provide a tenancy agreement proving the rent you pay.
    Since then i have read a few other accounts and they said the OR wouldnt contact the LL either, so not sure if there has been a policy change recently or if some OR's are pretty judgmental about your situation and want to cause you the maximum hardship.

    So i personally wouldnt worry. you could also ask your local county court which OR office they use and you could enquire as regards their policy on contact with LL.
    Life is like a game of Snakes & Ladders, i almost made it to the top but now i'm at the bottom again and its a very long ladder to the top. I had it all and now its gone :eek:
    Well my 6 years are now up, now to start to rebuild my life again

    I personally would try and findout (anomously) what this BR clause is on your agreement, as failing to disclose your BR could put you in breach of your contract and should they find out via a 3rd party (say a neighbour that doesnt like you) may have grounds to evict you, informing them may not make any change with the relationship between yourself and LL, it could be something to do with their buildings insurance ( i have seen some home insurance policies not accept BR's) or some other simple matter. its worth checking out to honest. I find it strange the OR isn't going to inform them though:confused:

    good morning to all. Regarding the BR and LL...i think it strange for the OR not to contact when money is involved. however, if you can prove via salary etc and have paid upfront for rent with no arrears then i dont see why it should be a problem.

    i do aggree EW with the comment of finding out about aggreement just in case, as the last thing anyone wants is to breach tenancy aggreement. Also as the BR notification appears in the local rag, there is s very small chance that neighbours or the LL him/her self may notice this and could be aggressive if you have not declared it. Thats the last thing you need after going through the stresses of BR.

    Very Grey area on LL and bankruptcy...not sure if my comments helped. just wanted to jot them down too..i am looking at rental pre bankruptcy now.

    Dave, i rented from an Estate Agent, however they said once all the paperwork is done I will dealing direct with LL (Nice guy im told!)
    Did not mention anything about my situation, just got through the credit check and got a guarantor

    Technically, the OR should arrange for a disclaimer (stamped by court) to be sent to the landlord. Basically, it states that as the property is rented then the OR has no interest.

    Letter not sent for coucil property or housing association though.
