A few questions, My partner is getting incapacity benefit, and in December we sent off an IB50 form for a review of her benefits. We have had no response from this as of yet, Does anybody know how long these things take? If she is invited to a medical at some stage, which she probably will as she has not seen her GP regarding her problems, and they decide that she is no longer entitled - which although so is incapable of work and shouldnt happen is always a worry, especially with the DWP (We would appeal if this did happen). Would she be entitled to JSA, if I work full time earning around 19k a year? Somebody told me that If your partner works, and earns above a certain level you are not entitled, even if your not married?

My o/h sent his IB50 in on first week of January and he received the letter back last week saying he didnt need a medical - when we phoned them because it seemed a long time we was told there is a backlog so whether that applies at all places Im not sure.0

I sent my renewal (?) form in Sept, I am in receipt of middle rate Dla care and higher rate Dla mobility. I received my letter back in January telling me that all was ok and that I would be reviewed again in 2012.0

My husband's took months as well.
There are two types of JSA, one is based on contributions and is payable for six months, the other is means-tested and if you are co-habiting your income as a couple will be counted so your partner robably won't get any.
But the other criteria for JSA is that you have to be looking for work, which you've said your partner cannot do? So I don't think they will be eligible for either type.(AKA HRH_MUngo)

Is she still getting benefit? If so, dont worry. But Im a bit mystified as to how you got incapacity without seeing your GP. To start off my claim, I had to send in a doctor's note which my GP completed.
I had a couple of reviews which were a form filling exercise and I dont remember hearing anything from them, I just continued to receive benefit. Is it her personal capability assessment? This year I had to have a medical, but it wasnt any big deal and nothing changed, I continued to receive the money.0 -
3 months is not unusual TBH, any longer than say 5 and I would query it. I think DWP are doing less medicals in anticipation of the new system when the tests will be much tougher.
