Natwest Default Notice, Iva, Joint Account-what A Mess!!!!!

I am really new to this site and am desperate for some help. I was on a DMP with paypal and without doing any research decided that an IVA was the solution after they suggested it to me. I am now about to make my 2nd payment into this plan and seem to be coping at the moment.

The problem i have is that one of the creditors on the IVA, i have now found out, is a joint account with my partner. now this is where is gets complicated!!!

We went to natwest and they agreed i could take sole responsibility for the account back in november. We filed out all the necessary forms and my partner had to sign agreeing to destroy all of the cards and cheque books etc. They advised us there and then that it was a done deal. At the time i was determnied to get our finances back on track but unfortunately i had to apply and got on the IVA in February of this year. Now, when i filed out all the forms for the IVA and it was accepted, through my own stupidity i did not realise that Natwest had not transferred the account into just my name. Therefore they are trying to now claim the full ammount from my partner due to me being involved in the IVA.

My partner is devastated and while she accepts some of the £3,600 is her responsibility, Natwest are demanding the full ammount FROM HER!

We have written to the Customer Relations Department to request they look into the matter and to remove my partners name for the account, as initially agreed nearly 4 months ago, but as they now know i have and IVA they are not too keen to do this as they want the full ammount back.

We have today received a letter from their collects department which is headed 'FORMAL NOTICE OF INTENTION TO FILE A DEFAULT AND TO TAKE ACTION TO RECOVER DEBT''

I really don't know what to do. My partner has contacted them (they won't deal with me) to try and set up a repayment plan and we have sent them our household income and expenditure form which literally shows there is no money to make a large repayment, but they will not accept payments from her as they claim this will make them a preferred creditor of mine so MY PARTNER LITERALLY CANNOT WIN!!!

If anyone can help, please do as i really don't know how we are going to get out of this mess!!!

    Post on the DFW or bankruptcy board as there are many, many people over there doing similar things!

    Contact your IVA people and let them know the situation they may be able to help if not look on DFW form in there is the number for several debt charities that are not set up to recommend any particular solution but to look at the whole picture.

    Whatever you do dont ignore it as it wont go away.... you can sort it so dont panic CAB ae always good ones to contact and as already advised pop onto the DFW forum many of us lol have experience of this...so chin up xx
