I bought a specialised piece of DIY equipment 3 weeks ago. There were a few BIN auctions for the same thing.
I got an email telling me the item was found to be damaged so they could not send and offered a refund or I could wait 2 weeks till they got another one. I opted to wait as this item isn't easily found at this price.
I noticed another person had also bought and had been told the same thing so he opted for a refund and left pos feedback.
All the other BIN auctions they were running were withdrawn at the same time.
As 3 weeks have now passed, I have emailed to find out what the situation is and I have had word back that the manufacturer cannot ship to them quickly so they will refund me. (I'm fairly sure the item is an import so will be subject to longer delivery times.)
That email was quickly followed by another from ebay asking for confirmation that we had 'mutually agreed' not to proceed.
Now my thoughts are that this item was never in this seller's possession in the first place so he was running auctions for stock he didn't yet have. (Seems strange that both myself and the other buyer had the 'damaged item' email and all other auctions for the same item were pulled?)
As the stock hasn't materialised, he cant sell it but doesn't want to pay his ebay fees either. Seems a bit of a chancer and a time waster.
He has good feedback though for this and other items so he's obviously sold a lot before this.
I just think I've had my time wasted and he's had over a hundred quid of my money for 3 weeks for nothing. I daresay I wont get a refund until I answer the ebay 'mutually withdrawn' email either so I probably have no choice but to comply on that anyway. Not sure what kind of feedback to leave on this tbh.

Why not mutually agree it if it means he gets his fees back?
he offered you the option of a refund from the start and you chose to wait, you cant prove he never had the item to sell and even if he was shipping from elsewhere although against ebay rules you would of happily accepted it if it saved you money. :rolleyes:
Be a fellow ebayer and mutually agree it doesnt cause any problem for you and if by some small chance he has them available before you find another one he'll still be your 'ebay friend' to buy from.0 -
I'm not sure though how mutual this was..after all you still wanted the item and agreed to wait for it. Mutual means you both agreed that you didn't want the item.
If it isn't mutual then merely tick the option and state that you would have still liked the item. It's a risk any seller takes when they drop ship and don't fulfil the ebay requirements by stating that correctly on their listings.
