Bank Charges - When does the test case end?

                    Just had world war 3 with First Direct.
I very very rarely got overdrawn on the overdraft on my account. In fact in the whole time I've been with them approx 3/4 years I only ever got charged £80, which of course they very nicely (LOL) gave back to me last year!
Any way I've gotten charged again. This time £25. Have just spent half an hour onthe phone to them and they reduced it to £13 and wouldn't budge. I actually cried. I feel very stupid and very drained and a bit rediculous now tbh.
Its been a bad week and this morning has kinda topped it all off. People are a lot worse off than me, i'm such a drama queen!! LOL
There is a point to this thread I promise! I know all charges reclaims have been put on hold so do we know when this will be finished? I'm obviously going to try and claim it back.

            It seems to be going on for ever - doesn't it?

I suppose that, on a positive note, there must be a good case for the charges to be unfair, otherwise the Court would have thrown out the case by now.
It still seems unfair, to me, that whilst we, as claimants, have had our cases 'put on hold' pending the outcome, the Banks seem to be able to act as they like. :huh: :huh:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

            Well fingers crossed it goes our way and then I can claim my £13 back!! It seemed odd to me that he was able to refund £12 of it. Maybe they have an idea that the limit they can charge will be £13??0

            well i've got £865 riding on it! I hope they resolve it soon!
I think that the banks are disgusting, i partially blame them for getting me into this mess (although I realise that I should have stopped over spending earlier!) If they hadn't kept whacking huge charges on me then my other direct debits wouldnt have bounced and my overdraft wouldn't have gotten bigger!!!
There..... i feel better for that rant now!
Guys, i do realise that I shouldnt be blaming them, I have nobody to blame but myself but the banks don't help peoples situations with charges like that!!0 -

Why, jg - it takes two to tango - and surely the banks must bear some responsibilty for allowing you to operate your account outside of your limit, and further compounding the problems by imposing their charges?
Certainly, in my case, when a direct debit would have put me £2.00 over my limit, the Bank (HSBC) refused it and applied a charge of £28, which put me £26 over my limit - they, then charged me for being over the limit.
Oh, by the way, there were, at the time, cleared funds in my account, which, whilst visible on the 'pending' screen of the computer, would not have been credited to my account, until the close of the working day.
A quick check, and a bit of 'human intervention, could have seen that I was good for the funds, and could have authorised the transaction.
Add to that, the hassle, and charges that I got from my mobile provider - to whom the direct debit was due, I most certainly feel that the Bank should share some of the blame.

            I agree about banks sharing the blame.
I was in the same position with HSBC, they would let me go into a £1000 unauthorised overdraft and then charge me £150 at one point. To an irresponsible young person such as myself this will get you into debt fast.
I remember one month they called me and asked if I could pay my overdraft incl charges, I explained that my salary was due in at the end of the week and that it would cover the amount to which they told me that was not good enough and advised me that I take out a loan from them to cover the £500 unauthorised overdraft, unfortunately the lowest loan amount I could take was £1000 and that was at 20% interest.
I believe that I have to take the blame for being an idiot and you cannot improve your situation until you admit that to yourself as part of your LBM.
That said they do make it so easy for you to be an idiot.
I wouldn’t jump over a cliff but if somebody told me I needed to and that its ok my injuries would heal in nice managable installments it would increase the chances, especially if I was an idiot.0 -

Arent they the same company as HSBC? I had to ask for charges to be refunded last week and was told they could do a partial refund, I said that I wasnt happy about that, so they spoke to a more senior member of staff who waived the whole amount as she had authority to do so, maybe you just need to speak to someone higher up? Hope you get it sorted, and hope they sort themselves out with this test case, I could clear a large amount of my debt with the amount I am claiming back.0 -

Well I kept asking to speak to someone higher and higher up and I apparantly spoke to the highest person there.
I said that I couldn't afford £25 and he had the check to point out that I £90 in my savings account! As I informed him that was there set aside for my car tax. Cheeky git!! LOL
I suppose its my own fault - I should have checked my account Friday morning like I normally do, for whatever reason, I didn't. But £25 is sooo much! Even £13 has stretched my budget big style next month.0 - 
            I'm with A&L and they have a policy where all DD payments 10.00 and under do not get charged for bouncing.
So what happens to me, they authorise a £3.00 DD, I go 75p overdrawn and they whack me for £45 worth of charges (£5 per day for 9 days).
How fair is that??!!0 -

            well i've worked out i can claim 300 smackers. Hope the test case is resolved soon, otherwise short of sending the boys round and setting the dogs on them
