Advice Needed

Can anybody offer me some advice?
I bought a handbag on Ebay for £75 paid £8 for 1st class recorded delivery postage and paid via cheque (seller does not accept Paypal). Cheque was cleared over a week ago and seller has advised me that the bag has been dispatched. I have requested tracking ref number but it seems the item hasn't been sent recorded delivery but standard 1st class post - seller has receipt for posting. Is there anything I can do? The seller has obviously posted the item but not under the terms of the sale. (Feedback rating is 45 and 100% positive).

Ouch. I trust they had excellent feedback for you to want to risk paying that much via cheque?
Your only hope is for the buyer to refund you... so I really hope the above is so.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

It was posted last Tuesday - I know RM say to allow 15 days before you can class it as lost but I have a nasty feeling this has gone astray. Is there anything I can raise with Ebay (if it doesn't arrive within the 15 days) seeing as the seller did not post it as advertised in their listing? The seller only sells this particular make of handbag and all of the feedback comments are really good with many stating quick delivery which is one of the reasons I decided to buy it even though the seller doesn't accept Paypal.0

OP, unfortunately ebay won't help you, as you paid by cheque.
It's the seller's obligation to raise the issue with RM, not yours... but if they do, they will only get up to £34 compensation. If they don't know that yet, I would try to get a refund before they realise!
Your best hope is to keep the seller sweet and hope they're willing to refund you if necessary.
By the way, have you checked with your local delivery office? RM don't always bother to leave a card.My TV is broken!

When you look at the auctions on ebay and scroll down to payment methods it states that cheques have no ebay protection at all..so that answers that question.
Basically fay has covered this all, you are completely reliant on the seller to get this to you and if it fails to arrive dependent on their good will to refund you unless you want to go down the small claims route. A seller with no paypal offering recorded delivery on a £75 handbag obviously doesn't understand the system anyway..handbag is not covered against loss as special delivery should have been used. So knowing that the seller will not be able to recover her money from RM rather puts a dampner on the whole thing.
Whilst it will not get you your money back but assuming bag is just not en route somewhere, and it is still early days yet, you can make a non performing seller complaint. This does mark the sellers account.
