Please can anyone advise me of the best way to tackle my problem, I cant see any similar situations when I searched, but I as I am really angry I might have missed something in my haste.
1st April 2005 my solicitor repaid the full amount of my debt to Red Knight who were acting on behalf of the Nationwide Credit Card.
Now last week out of the blue I received a letter from Cabot asking for the full amount of my debt with Nationwide. Knowing what Cabot are like, I didn't reply to them but wrote to Nationwide asking what they were doing discussing my details with a dca when debt had been settled etc.
Two days later got a letter from NW stating that my debt had been passed to Cabot.
Today got 2 letters from NW first one saying they would investigate and second one saying that no payments have been received since Feb 05 and that they had a letter on file from late March 07 saying that I thought that debt had been cleared by PPI. They also reiterate that I must deal with Cabot from now on as I still owe this money.
I haven't been in any correspondence with them since 05 so this is not my letter that they have on file, but I do have a copy of my sols letter enclosing the cheque for the full amount of the debt dated 1st April 05. Surely there would have been some correspondence if they truely believed I owed this money sometime over the last 3 years?
Now I know I am ok as I have this letter but this is scary stuff. I am going to write back (as think it would be best to write rather than any phone conversations) and ask for a copy of this so called letter of 'late' March 07. I plan on telling them that I have proof that this debt was setted, but thought I shouldn't make it easy for them by just providing a copy at this stage.
What would be the best way of dealing with this. I obviously am furious at NW, surely this is Fraudulent and against OFT guidelines? I want to go back hard as I can at NW for this.
Any suggestions?

Why would you not send proof you had settled the debt? I would see this as making it easier for yourself. Have you checked with the solicitor that the cheque they sent has cleared?0

The cheque cleared 3 years ago, I have had not heard anything from them for 3 years and now they say I still owe the debt.
I do not owe this money but they have passed on my personal details to a dca and want me to deal with the dca direct.
I have written and told them when the debt was paid but they are not interested,

Have you checked your credit file? Might be worth a look.
I would suggest you write to Cabot, and ask for a detailed statement, and proof that the amount is outstanding. Rememeber it is for them to proove you owe, not you to prove you dont.
I can understand that you are blowing your top, but please take it one step at a time, and feed the rope out to NW and Cabot slowly:D
Once Cabot have confirmed (in writing) that the money they want is indeed the same as that which you repaid in 2005, then you can go after them via Trading Standards/Information Commissioners Office, anfd in the case of NW the FSA and OFT[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

I suggest you only ever communicate with a DCA in writing, never use your real signature, and not divulge your phone number. Insist that all cummunication be in writing. In short, stay in control[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j
