landlord

i am new to this site and just trying to navigate around it so i hope this isnt seriously in the wrong place?! i was having difficulty posting in a few forums as it said i couldnt post

Myself and 2 friends, have to move for our jobs with a company, and we rented a place in Swindon with 3 bedrooms.
We each paid our £400 deposit, so £1200 in total, and a months rent upfront e.g. another £1200. We signed a 7 month contract and told the agency - NFJ - it would only be 7 months due to relocation at the end of this period. All fine and the contract states 7 months. And now I work in Liverpool.
In November we rang the agency just to remind them we would be moving out, and we were told we did not need to put it in writing for moving out. We then rang again middle of December asking what the procedures where for moving out as we had an inventory compiled when we moved in. This time however we were told we needed to put it in writing and they had no record we were moving out. As such they wanted to charge us for Januarys rent as well. This was paid because we paid a month in advance and so it came out in December before we realised to stop the standing order. Yes that was stupid! The agency is refusing to pay this back to us. They have also not returned our deposit either yet.
We have a copy of the contract and it clearly states a 7 month contract and indeed nothing is on there about us needing to put it in writing. However sneakily the contract they gave us, is a page less, as we apparently signed a contract with an additional page at the back saying we would have to put it in writing according to the agency. However this page wasnt given to us when they gave us each a copy. Irrespective of this anyway it clearly states a 7 month contract AND we rang up about giving written notice to be told it wasnt needed.
So in essence they have £2400 of our money at the moment. They are "still" compiling how much deposit we will get back but they have said it will be minimal due to dust etc being pedantic. Clearly so since we moved out before xmas and they didnt do the inventory check until February, saying we owed them for the January rent.
We cannot speak to the manager of the agency as he will not take our calls. We have written numerous letters but are gridlocked and getting nowhere. Indeed we had problems with the microwave the first day we moved in, documented on the inventory, but it didnt get fixed until December. They have proved a nightmare.

Does anyone have any advice or suggestions, PLEASE, PLEASE as this is a large amount of money of ours.

  • Send a letter before action, giving them 14 days to return your rent and deposit, and say that if you don't get it, you will sue.

    Give them 21 days, then issue small claims proceedings (really easy, you can do it online).

    Was your deposit protected? When exactly did you tenancy start?

  • it is protected by tenancy deposit solutions. i have written and emailed them now explaining it all and here is hoping. over this time period the property agents non return is frightening. there should be greater protection against such rogues
