The magistrate would only decide on the case if it ever gets to committal action - before that stage the council could have issued a court summons and issued the account to a bailiff for collectionI no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

Well the bailiff wouldnt get very fair without a court order surely so there would have to be a hearing to check that money was owed then isnt there another one for non payment before the bailiffs get called.
I`d love to see how they could justify going to court because someone wanted to pay monthly.
Although this country is going to the dogs
(off topic did you know you could actually be prosecuted for moving through a red light to let emergency services through)0

Once the council issue a court summons for the outstanding balance then the magistrate will isuse a Liability Order - at this stage all the magistrate rules on is whether the correct person has been billed - they leave the rest to the council to deal with..
As soon as the Liability Order is issued then then council can issue straight to a baillif for recovery - no further dealing are had with the court unless the baillif cannot recover the money owed and the council requests committal.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. i am disgusted with my local council tax department. BASILDON!
recently they moved offices for which they were paying something astronomical for rent, over £100000 a year.
whilst they were in the prosess of moving they had a skip placed outside for all the "rubbish". They threw away folders, books, pens, pencils, all types of stationary, shredders, fans, waste bins, even printer cartridges which i salvaged, all sealed in the boxes, and they are worth over £75 each!
they also had family members coming and going taking what they wanted from inside the building.
in november i was out of work for just over a week, i claimed benefit for my rent and council tax, when i did get back to work having missed 3 weeks payments (i usually pay £20 a week which is all i can afford)
i then received 2 letters, both of whcih asked me to pay £64 now! i couldnt and told them this, and asked if i could pay £20 a week, which is what i have done for over 3 years, i was told no! and this will be going to court!!
i then had £95 court costs, added for what??? i then filled out a form to state how much i was willing to pay... i siad £20. again they refused.
It has now gone to bailiffs, and they have added £25 on top of what i owe! during all this time i was continuing to pay my £20 a week, i never once stopped, apart from when i was out of work, my bill to this day is below £100, but becasue of court costs and baliff charges, it is over £200. maybe the council should try helping people instead of penilising them!
I also got told in a baliff letter that full payment id due immediatly, now if i could pay it in full, i would have paid the council!!0
