All you have to say if you intend to make a JSA claim now, is that you want to claim JSA - from whatever date you wish- the earlier the better- half term is only 2 weeks away. Ring JCP on 0800 055 6688.
Just assume that you have lost your IB appeal. By the time your JSA claim would/could be sorted out, your appeal is going to be heard.
If you win-you win- and as I said, your IB claim would be reinstated, just then cancel your JSA claim before you go abroad, but tell the IB section at JCP now - ask for form BF5.
If you lose, your JSA claim is sorted out, and any IS offset against your JSA due hopefully without any break/delay in payment.0 -

I think you sound a little negative about winning your appeal, as a matter of interest how many points did you receive, have you asked an advice centre if they can help you with submission and representation, could you ask your doctor for a letter of support, any nurse,councellor or consultant who may help. Be positive mate and good luck!!Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -

the reason i'm negative is because i was awarded ZERO points, the doctor was talking about someone completely different to me, and from what people have told me i don't stand much chance, i'm waiting on a hospital MRI report, i already have the full scans with me, my doctor has moved on, so i will try to get a letter somehow0 -
Have a look at the submission papers for the descriptors and work out how you would meet the 15 point threshold. Your records would still show what medication you receive and the reports from your previous doctor on case.
Maybe make an appointment with your new gp and explain to him your problem, if he is any way supportive hit him for a letter of support but a lot of G.P's now say tell your rep to write as they then charge for this service. What are your ailments(if it's too personal that's o.k) but do look at the descriptors and get help from the cab, if too busy they should be able to help with your submission at least which will give you your arguments at the hearing.Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -
well it seems you need 15 points to qualify, i know with my symptoms i can easily qualify. I have a protrusion on my lower spine, which pushes on my nerves which creates pains in my leg and toes
i cannot stand in a queue or sit too long or walk far without pain0 -

Sorry to hear about your disability must be painful.
I do wish i was representing you.
I think you should be fine:
Cannot sit comfortably for 30 minutes or more without having to move from the chair=7 points.
Cannot stand for more than 30 minutes before needing to sit down=7 points.
Sometimes i repeat sometimes cannot bend or kneel to pick up a piece of paper and straighten up again=3 points.
Sometimes cannot rise from sitting to standing without holding onto something=3 points.
Cannot walk more than 200 metres without stopping or in severe discomfort=7 points or cannot walk more than 400 metres=3 points.
27 points mate.
GET HELP!!!
If your tribunal is soon try and get it put back(due to ill health on the day maybe)arrange an appointment with new GP and let him know about the appeal. In genuine circumstances they are sympathetic to you, get list of painkillers(prescription)and ask for letter outlining your disability.
The hearing is not a medical and they are independant and whilst sitting there if you show the lack of comfort and pain you suffer i guarantee you will win your appeal. SO CHIN UP AND FIGHT THESE AMATEUR DOCTORS WHO SEEM TO KNOW IT ALL. oNLY YOU KNOW THE TRUE EXTENT OF YOUR AILMENTS....Good luck and keep me posted....AllenForums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.0 -

Just wanted to update you.
after 10 days of anxious waiting, i finally heard back from the tribunal people to say they have agreed to postpone my hearing until after i return from my holiday.
That is such a weight of my mind.
I have no new date yet, but at least they have agreed to wait until i return now.0 -

i don't mean to make you to anxious when i say this but becareful when you go for your appeal as now they will be aware that you went on holiday and will ask questions or still make assumptions about you from that.
just as an example one of the reasons i failed at appeal was that i can't pick a 2.5cm coin up with my right hand, but they have took it on them selves to say as i can pick a car key up (which i do with my left hand and it is on a bunch) and put it in ignition i would have no problem with a coin!!!!!
i am just saying that if your holiday includes walking or similar then becarefull and make sure you stress the amount of difficulty or pain you suffered in doing so.0
