Southwark Council parking fine
Hi,
During the past year, my husband and I have been travelling to London to hold a stand on Borough Market, in Southwark.
There are parking restrictions in the usual areas in which we parked on Fridays (and we therefore avoided them), but these were not in force on Saturdays (or so we thought).
One Saturday last April, my husband went to park our car in a different area (but still in Southwark), in fact, in the next street over to where we usually park. When he went to get the car that afternoon, we had been issused with a parking fine, as that area was restricted also on a Saturday (but none of the other cars also parked there had been ticketed, or had any permits showing). As far as we were aware, and as far as the other traders and the shopkeepers on that stretch of road were aware, the same parking restrctions applied here as everywhere else.
There were no roadside signs, and when we drove around, we could not see any posts showing parking restrcitions in that area, or on that road.
We have appealed and appealed, but the council have rejected everything we have said, stating that they do not need to show signs on every road. As far as I am aware however, they did not have a photo to prove the contravention.
The fine, originally £100 has now gone up to £150
. Even if we had the money I still find this a staggering amount to have to pay, as this is about 80% of our weekly budget, and we don't live in and around London (Derbyshire), so how are we supposed to know where we can and cannot park, if it isn't signed?
Sorry for the long post, but I hope someone can help
.
Tracy

In my experience a great many parking bays in London are wrongly painted and not enforceable.
I suggest you go to the place you parked, take photographs of local signage, the bay itself, the street (showing all the bays), and scan your documents, and go to www.pepipoo.com
For example, I was ticketed for parking here (the Micra is not my car)
In Islington. A £120 fine if not paid. I appealed and won, because the bay is completely unenforceable.0 -
I have to say i can't see why you got off - the lines aren't perfect but you should have lost under the 'de minimis' rulings.
I can see defects in the lines in that along the length of the bay you also have a second faded white boundary line - the lines do not appear to be exactly 100mm/10cms thick.
the lines along the length - although helpful - are not as per the parking and traffic signs regulations.
although i cannot judge from here the bay looks a little bt on the skinny side coudl it be under 180 cms also.
perhaps there also is no sign accompanying the bay also?
come on let me in on the ruling - why not scan and publish the letter conforming your win and the reason for it - otherwise people like me will wonder if you really did get off or not.0
