Pre 29th April 1988 or after?
Was the endowment sold by an employee of B&B or by a local solicitor, accountant or what is now an IFA?I am an Independent Financial Adviser (IFA). 29th April 1988 is the date consumer protection and regulation really began. Building societies are awkward as many had local arrangements where they would get someone in. Others took responsibility for those sales. I think B&B took responsbility for the sales so you should complain to them. In which case, the start date wouldnt really matter.
Complaints are reviewed based on the rules that were in place at the time of the sale.I am an Independent Financial Adviser (IFA). thanks again, it appears we took it out in late 87, we have already com nplained to bbbs, but they gave us the standard 6 weeks limit for them to investigate /out of time, , out of there hands reply,
i will admit it was pointed oput to me at time of signing that there was centance in the contract ststing there was no garantee to pay out my wife and i noticed this and asked the fella dealing at time of sighning exactly what that meant, , he told up to basically ignore it as the bbbs garanteed it would pay the sum needed,
would i be correct in thinking this is the stumbling block , hes word against ours, he is apparently non traceable, lol.
as i see things i was lied to by someone in the bbbs , so therefore misslead,
i was asking the origional questrion to find out if anyone else had encountered the same line, , as at the time i suspect most sellers would say the same thing to secure the sale,
thanks carl0 -
No, you stumbling block is the time bar. Once you are timebarred then its game over.would i be correct in thinking this is the stumbling blockI am an Independent Financial Adviser (IFA). what do you meen time barred,
carl0 -
You have three years from been notified of a high risk of shortfall on your statement. As they have replied that you are out of time, this suggests your three year window of claiming has expired. The majority of endowments are now time barred and this will increase during 2008.I am an Independent Financial Adviser (IFA). hi, they did not replty telling me i was out of time , they were implying they were only allowed 6 weekd to investigate it then , then i must follow any further action up with the onbudsman,i registered my complaint with the ombudsman around april 2003, well inside the deadline as i remember,
we received a reply from the onbudsman noting our complaint was files and they would do nothing else untill we contacted them again, we feel that time has now come now the kids are a little bit older,
also i have lost the reply from the onbudsman, so i am hopeing they will be able to find us froim our address, .
what do you think our chances are.
regards carl0 -
Doesnt sound right. A 2003 complaint, at worst, would have been resolved by 2005. There are timescales involved that if you go past that date will prevent you from trying again. I suggest you contact the FOS again and see if you are still able to continue that complaint.I am an Independent Financial Adviser (IFA). thanks again, but you seem to be missing the point, after the bbbs poo pood my claim, i registered my complaint with the onbudsman, within the .time limit, they notified me they had received my complaint, therefore having registered my complaint in time , i assumed there was no further time limit to carry out the final details with the onbudsman, as they never said there was in there reply, just the words. " we will do nothing more untill we here from you again, ". so it had laid dormant for 5 yrs, but know i feel i should resurect the claim, back then , all you heard on the tv and radio, newpapers was about registering you claim,, which i did, know i have the time and inclination i want to push for a result, does this make sence,
regards carl0
