Buyer is a con artist!

My niece, who is completely new to Ebay, has tried to sell a perfectly good mobile phone on Ebay. She has simply upgraded and wants to sell her old phone.After selling to someone who wouldnt pay she relisted the phone again.
The winning bidder this time won her phone at a price of £87 and £5 postage. However, looking at his profile he only has 1 feedback comment and it says "beware, scam artist. Reported to Ebay". So how come he is still on there and able to bid?!!!
She is getting most disheartened. She just wants to sell her phone and get herself some extra Christmas money. She has reported him to Ebay and has offered the phone to the next bidder who has very good feedback, but will she get her final value fee back from Ebay? Also, will Ebay do anything about this fraudster?
His phone number is false and doesn't exist and neither does his address. He sent an email saying he will send payment by cashiers cheque drawn on a uk bank and can she send it to Holland!!!!!!

I would report him to ebay, and also file an unpaid item dispute, which will get you your listing fees and final value fees back.
Also you can block him from bidding on any of your future items.
But i'm afraid this is a drawback of Ebay, but dont let it put you offRock on MSE!!!0 -

They are obviously hoping my niece will send a cheque for about £4,000 and then find that his original £4,200 payment hasn't gone through.
Ive reported him to ebay but don't know what will happen next as he has already been reported before! Perhaps we should go along with him to get him going and send him a dud cheque!0 -
what was the extension on the email address, that usually gives it away.. i had somebody in India wanting to buy my mobile on buy it now... but his email address was blahblah@blah.de which isn't Indian0
