    Police have 6 months in order to get you to court. The handbrake not working would be 3 points as it's considered as dangerous parts. You're lucky that the car wasn't prohibited by the Police when you were stopped.

    Temporary cover notes are a problem as you've found out as they don't post you anything (despite the law stating you actually have to be in possession of the certificate to be covered on a particular vehicle. There is no such thing as phone insurance etc).

    Yes they do have the right. They have the right to carry out any tasks as necessary to check the operation and functionality of mandatorily required components.

    Think yourself lucky. Get shirty and they could call out a VOSA inspector who can cause you a whole lot more grief as they can inspect it to MOT standards.

    You don't use the handbrake for stopping but to stop you moving, sounds a bit over dramatic to me.

    So you're on a hill at a junction. Can you guarantee that without the handbrake, you wouldn't roll back a couple of feet before you managed to get moving forward?

    Before reading this I have to say I would probably have used a car with a broken handbrake that was going to be fixed. I would of course ensure I parked on flat ground and in gear, and take some wheel chocks along.

    i currently am,my handbrake cable snapped in my van the other day.it will be fixed soon though.

    But you probably would not give the police cause to stop you in the first place.;)
