Transferring title deeds to wife only

Hi all.I am writing in the hope that someone can give me any advice on something we are thinking of doing.My other 1/2,who owns 1/2 my home,has got himself into debt problems,and since I have found out,I have been repaying this back at a lower rate, agreed beforehand with each company.What I want to know is ,if it would be legal for my husband to transfer the house back to my name only,as I am worried sick,as this is my only home,and all that we have as assets.He has said he will sign over his half to repay me for all the effort I have and AM still going through,to keep a roof over our heads.Any good advice would be very much appreciated. Thank you.:confused:

  • Its not straight forward as you would hope. My first point of call would be the citizens advice bureau. Go and discuss your concerns with them. They will try and put your mind at rest as well as giving you unbiased free advice.
    I dont understand why people would ever pay for mortgage advice when many brokers like me dont charge a penny!:confused:

    I am sure this would be seen as an attempt to defraud his creditors if his debts brought him before a court.

    There is nothing to stop you doing it but I think a court would set it aside.

    As long as none of the debts are secured against the house, then you don't have to worry - No court is likely to turn you out of your house unless you agree to it (which is what a secured loan makes you do!). The very worst they could do is make him bankrupt, but even then you'd be safe as that's a personal issue and wouldn't affect you, unless you were a party to any of the debts of course..
