If you have not made payments towards a debt for 6 years and not acknowledged the debt in writing, then it is probably statute barred. There are letters here you can send to inform them of this.

ant - you are probably right on all counts but i would guess that this is the same debt. The first DCA has probably sold it on to another DCA who are now trying to collect from the previous occupier.
After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    Dad Gift 6k ¦ Savings & Inv Tst: £2,500
    Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0

    Total Owed: £2,270 (+6k) 11/08/2011
  • bcw sent me a letter formal demand for £1,019.76 ref O2 fone bill. I had disputed the debt with o2 and said it was incorrect and should be around £700. BCW then said if i paid £408 as final settlement they would close the file. it amazes me how much these companies profit from customers. O2 etc. bcw said i need to take it up with O2 can any one advise me about this please.
  • Hi,
I'm a newbie who needs advice.

BCW have sent me a letter regarding a debt with NPower that i know nothing about and they've got the details wrong on the letter IE my 1st name.
Is there anything I can do regarding this, I've been reading this and other forums and it would seem calling is not the answer but have I back up if the info is wrong??

    Thanx

Hi Tankster, they are probably 'fishing' for someone with a similar name to yours, Don't phone them, it's up to them to prove that the debt is yours

It's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.
We dont count all the runners ahead of us & feel intimidated.
Instead we look back proudly at our journey, our personal struggle & determination & remember that there are those that never even attempt to reach the starting line.
  • This company keep phoning me about 6 or 7 times a day. I thought this was harassment and they were not allowed to do this?

  • Yeah, but they don't want you/us to know it is. ;) BCW are one of the worst out there. I had a dreadful call a while ago, before I knew what my rights were and was a little 'green'. Let's just say, if I'd taped what was said AND how they phoned me back up seconds later to threaten me - and I use that word in the correct context because that is exactly what they did - I could have gone to the police with it.

And to tankster, what BOS said. Phishing/fishing. And you are right, never call them. Once you do, they will not stop hassling you and you may also be acknowledging a debt that isn't even yours. Simply put, they don't care. As for 'record keeping' - hah!

To rid myself of these incessent creatures (not BCW but other of my creditors) I was forced to get BT choose to refuse. But then, they often revert to witheld numbers on the off chance you pick up without knowing who it is. Either way, I will never speak to a DCA/creditor by phone again. If they can't get the message that's their problem. Or change my number. Which I shouldn't have to do under reasonable circumstances.
Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.

I have received letters from this company regarding a person that does not live at my address. The first two I sent back unopened saying this person no longer lives at my address. After receiving the third one, I opened it (the envelopes were marked Strictly Private and Confidential but did not have a return address). The letters are concerning a debt for the person named.

Are they a legitimate company that I can write to and state the person no longer lives at my address? I am concerned that the debt will show against my address or that someone might come and try to seize assets from my address (which the letter states could happen).

    Any suggestions?

I'm in pretty much an identical situation. I'm just going to keep sending them back marked 'Not at this address'. They won't send any bailiffs round or anything, they are just threatening. I'm also pretty sure you can't get a blackmark on your creidt report just because of your address - its your name that counts. Whatever you do - don't call them, it will only encourage them.

If you can see this bit the bit above says thread tools - you need to go back out to the list of all the threads - click on the bit that says debt free wannabe at the top under the navigation - you should then see something that says forum tools and can do it from there?
Um will pm a board guide and see if they can move the posts to a new thread for you.
