Advice Needed - Getting hassled from BuchananClark + wells

Hello I am wondering if someone could help, I have been getting numerous calls and now a final notice letter, from Buchanan Clark + wells, saying that I owe money to their clients. I know I don't.

Although the letter they sent had my name on it, it had a wrong house number on it and the times at the address, differed widely to when I was living at the area. Also it only had a surname, so could be someone of the same surname.

Because, of the amount of nuisance they have been, I wondered if someone could tell me the best way to make a complaint in the strongest terms. As they don't seem to be agreeing that it is not my debt. And have been hassling me for weeks, despite me explaining the facts and being co-operative with them.

    Just write a letter to them , request they cease from phoning you . Say you will be recording any further calls and you will report them to TS. Do not correct an details they have ,just say they have incorrect details. If they have stated what or who the debt is from , tell them you have no knowledge of this . Ask them to check with their client . good luck ps Do not sign or put your name , just use their ref number .

    Ive been having problems with these too. I have phoned the national debtline and they advised me to tell them (BCW) that you are excercising your right to deal only in writing and tell them to stop making phone calls.

    The debt is an old debt and BCW have to prove that is claimable under a legislations that changed in the 90's that say debts over a certain age cannot be claimed.

    Dont let them scare you, they are just bullies.

    yeah i read it earlier, the company looks like a complete bunch of low lifes.
    Its good to have people who will give an insiders view.
    Even the lady at national debtline made a sarcastic comment about the company when i called them earlier lol.

    Having a lot of harrassment from Buchanan clark and wells, wrote to them stating that i wanted them to remove my telephone number from there records, as they have my home address, and i wanted correspondence only in writing, the debt is only for 247 pounds, and have been paying it off, as arranged with them, so why the harrassment? they have phoned twice today, refuse to discuss anything with them over the phone, they have completely ignored my letter, this company is a nightmare.

    This happened to me through 1st credit. The debt collectors often use tracing agents to try and find debtors - in my case they pulled my initial and surname out the phone book :rolleyes: - while trying to find someone with similar details who had not paid their gas bill.

    In terms of complaints, if it was me (and I complain a lot!) I would certainly tell the OFT that BCW are acting contrary to the OFT Debt Collection Guidance Note 2003. They can't act on individual complaints but they will add it to the files they have on a particular company and may do something about it if they receive a sufficient number of complaints. (Although one person's life disturbed by companies like this is one to many in my eyes).

    Ask for a copy of the CCA relating to this debt - which will cost a £1 and will let you see what information they are basing all this nonsense on.

    I know from my experience with 1st Credit, it was a nightmare.
    Almost debt-free, but certainly even with the Banks!
  • Had a couple of calls from BC&W in the past couple of days (dont know if they've rung before as I'm usually at work). When I answered the first time there was an automated message saying "(No specific name mentioned) Please ring BCW on 08(whatever), quoting reference...blah" (I hung up before it got any further as I thought it was telesales). I did some Internet searches of the numbers that had shown and BCW was flashed up as the culprit, and details that they were a DCA.

    The only thing I can think of is the previous owner of the property had a debt to Powergen (with whom I had lengthy contact and supplied forwarding addresses for him, etc. about 12 or so months ago), during this time I also had contact with another of Powergens DCA's who Powergen (supposedly)got in touch with to remove our contact details and we've heard nothing from anyone for about 6 months following all this.

    We've no other recent debts or anything we can think of and I'm going to check our credit report to make sure.

    My question is, is this likely to be a debt that BCW has picked up from Powergen? and what's with the automated message? Surely most people will ignore it as a telesales ploy
  • I'm having similar problems with a debt collection agency saying i owe money from 9 years ago, i have asked them to provide evidence which they can't do, do you know more about this legislation on old debts?
